Common use of User Conduct Clause in Contracts

User Conduct. As a condition of use, you agree not to use Company Properties for any purpose that is prohibited by this Agreement or by applicable law. You shall not (and shall not permit any third party) either (a) take any action or (b) Make Available any Content on or through Company Properties that: (i) infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any person or entity; (ii) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-mail; (iv) involves commercial activities and/or sales, such as contests, sweepstakes, barter, advertising, or pyramid schemes without Company’s prior written consent; (v) impersonates any person or entity, including any employee or representative of Company; (vi) interferes with or attempt to interfere with the proper functioning of Company Properties or uses Company Properties in any way not expressly permitted by this Agreement; or (vii) attempts to engage in or engage in, any potentially harmful acts that are directed against Company Properties, including but not limited to violating or attempting to violate any security features of Company Properties, using manual or automated software or other means to access, “scrape,” “crawl” or “spider” any pages contained in Company Properties, introducing viruses, worms, or similar harmful code into Company Properties, or interfering or attempting to interfere with use of Company Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” Company Properties.

User Conduct. As a condition of use, you agree not to use Company TPF Properties for any purpose that is prohibited by this Agreement or by applicable law. You shall not (and shall not permit any third party) either (a) take any action or (b) Make Available make available any Content on or through Company TPF Properties that: (i) infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any person or entity; (ii) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-maile‐mail; (iv) involves commercial activities and/or sales, such as contests, sweepstakes, barter, advertising, or pyramid schemes without CompanyTPF’s prior written consent; (v) impersonates any person or entity, including any employee or representative of CompanyTPF; (vi) interferes with or attempt to interfere with the proper functioning of Company TPF Properties or uses Company TPF Properties in any way not expressly permitted by this Agreement; or (vii) attempts to engage in or engage in, any potentially harmful acts that are directed against Company TPF Properties, including but not limited to violating or attempting to violate any security features of Company TPF Properties, using manual or automated software or other means to access, “scrape,” “crawl” or “spider” any pages contained in Company TPF Properties, introducing viruses, worms, or similar harmful code into Company TPF Properties, or interfering or attempting to interfere with use of Company TPF Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” Company TPF Properties.

You shall not (and shall not permit any third third-party) either (a) to take any action or (b) Make Available any Content on or through Company Properties that: (i) infringes any patent, trademark, trade secret, copyright, right of publicity publicity, privacy or other right of any person or entity; (ii) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-mail; (iv) involves commercial activities and/or salessales without altumAI’ prior written consent, such as contests, sweepstakes, barter, advertising, or pyramid schemes without Company’s prior written consentschemes; (v) impersonates any person or entity, including any employee or representative of CompanyaltumAI; (vi) interferes with or attempt attempts to interfere with the proper functioning of Company altumAI Properties or uses Company altumAI Properties in any way not expressly permitted by this Agreementthe Terms; or (vii) attempts to engage in attempt or engage in, any potentially harmful acts that are directed against Company altumAI Properties, including but not limited to violating or attempting to violate any security features of Company altumAI Properties, using manual or automated software or other means to access, “scrape,” “crawl” or “spider” any pages contained in Company altumAI Properties, introducing viruses, worms, or similar harmful code into Company altumAI Properties, or interfering or attempting to interfere with use of Company altumAI Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” ”, or “crashing” Company altumAI Properties.

User Conduct. As a condition of use, you agree not to use Company Scout Cloud Properties for any purpose that is prohibited by this the Agreement or by applicable law. You shall not (and shall not permit any third party) either (a) take any action or (b) Make Available any Content on or through Company Scout Cloud Properties that: (i) infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any person or entity; entity;; (ii) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; profane;; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-mail; e-­mail;; (iv) involves commercial activities and/or salessales without Scout Cloud’s prior written consent, such as contests, sweepstakes, barter, advertising, or pyramid schemes without Company’s prior written consent; schemes;; (v) impersonates any person or entity, including any employee or representative of Company; Scout Cloud;; (vi) interferes with or attempt to interfere with the proper functioning of Company Scout Cloud Properties or uses Company Scout Cloud Properties in any way not expressly permitted by this Agreement; the Agreement;; or (vii) attempts to engage in or engage in, any potentially harmful acts that are directed against Company Scout Cloud Properties, including but not limited to violating or attempting to violate any security features of Company Scout Cloud Properties, using manual or automated software or other means to access, “scrape,” “crawl” or “spider” any pages contained in Company Scout Cloud Properties, introducing viruses, worms, or similar harmful code into Company Scout Cloud Properties, or interfering or attempting to interfere with use of Company Scout Cloud Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” Company Scout Cloud Properties.

You shall not (and shall not permit any third third-party) either (a) to take any action or (b) Make Available any Content on or through Company CircleIn Properties that: (i) infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any person or entity; (ii) is unlawful, threatening, abusive, harassing, bullying, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-mail; (iv) involves commercial activities and/or salessales without CircleIn’s prior written consent, such as contests, sweepstakes, barter, advertising, or pyramid schemes without Company’s prior written consentschemes; (v) impersonates any person or entity, including any employee or representative of CompanyCircleIn; (vi) interferes with or attempt attempts to interfere with the proper functioning of Company CircleIn Properties or uses Company CircleIn Properties in any way not expressly permitted by this Agreementthe Terms; or (vii) attempts to engage in attempt or engage in, any potentially harmful acts that are directed against Company CircleIn Properties, including but not limited to violating or attempting to violate any security features of Company CircleIn Properties, using manual or automated software or other means to access, “scrape,” “crawl” or “spider” any pages contained in Company CircleIn Properties, introducing viruses, worms, or similar harmful code into Company CircleIn Properties, or interfering or attempting to interfere with use of Company CircleIn Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” ”, or “crashing” Company CircleIn Properties. IF, AT ANY TIME, YOU EXPERIENCE OR WITNESS ANY USER VIOLATING THIS SECTION 5, INCLUDING SPECIFICALLY, THE PROHIBITION ON HARASSMENT OR BULLYING, THEN PLEASE REPORT SUCH VIOLATION IMMEDIATELY TO US AT XXXXXXXX@XXXXXXXXXXX.XXX. WE RESERVE THE RIGHT TO SUSPEND OR TERMINATE ANY USER’S ACCOUNT AND/OR ACCESS TO THE CIRCLEIN PROPERTIES, AT IT SOLE DISCRETION, IF ANY USER VIOLATES THIS SECTION 5 OR IF WE REASONABLY SUSPECT THAT A USER HAS OR WILL VIOLATE THIS SECTION 5.

You shall not (and shall not permit any third third-party) either (a) to take any action or (b) Make Available any Content on or through Company AGGREGATE LLC Properties that: (i) infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any person or entity; (ii) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-mail; (iv) involves commercial activities and/or salessales without AGGREGATE LLC’s prior written consent, such as contests, sweepstakes, barter, advertising, or pyramid schemes without Company’s prior written consentschemes; (v) impersonates any person or entity, including any employee or representative of CompanyAGGREGATE LLC; (vi) interferes with or attempt attempts to interfere with the proper functioning of Company AGGREGATE LLC Properties or uses Company AGGREGATE LLC Properties in any way not expressly permitted by this Agreementthe Terms; or (vii) attempts to engage in attempt or engage in, any potentially harmful acts that are directed against Company AGGREGATE LLC Properties, including but not limited to violating or attempting to violate any security features of Company Properties, using manual or automated software or other means to access, “scrape,” “crawl” or “spider” any pages contained in Company AGGREGATE LLC Properties, introducing viruses, worms, or similar harmful code into Company AGGREGATE LLC Properties, or interfering or attempting to interfere with use of Company AGGREGATE LLC Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” ”, or “crashing” Company AGGREGATE LLC Properties.

You shall not (and shall not permit any third party) either (a) take any action or (b) Make Available any Content on or through Company Wido Properties that: (i) infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any person or entity; (ii) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-mail; (iv) involves commercial activities and/or sales, such as contests, sweepstakes, barter, advertising, or pyramid schemes without CompanyWido’s prior written consent; (v) impersonates any person or entity, including any employee or representative of CompanyWido; (vi) interferes with or attempt to interfere with the proper functioning of Company Wido Properties or uses Company Wido Properties in any way not expressly permitted by this Agreement; (vii) jeopardizes the security of your Wallet or anyone else’s (such as allowing someone else to log in to the Services as you); (viii) attempts, in any manner, to obtain the private key, password, account, or other security information from any other user; (ix) attempts to access another user’s Wallet, private key or other security information on any third-party site or services that provide access to such user’s Wallet or private key on our Services; or (viix) attempts to engage in or engage in, any potentially harmful acts that are directed against Company Wido Properties, including but not limited to violating or attempting to violate any security features of Company Wido Properties, using manual or automated software or other means to access, “scrape,” “crawl” or “spider” any pages contained in Company Wido Properties, introducing viruses, worms, or similar harmful code into Company Wido Properties, or interfering or attempting to interfere with use of Company Wido Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” Company Wido Properties.

You shall not (and shall not permit any third party) either (a) take any action or (b) Make Available any Content on or through Company DignifiHealth Properties that: (i) infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any person or entity; (ii) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-mail; (iv) involves commercial activities and/or sales, such as contests, sweepstakes, barter, advertising, or pyramid schemes without CompanyDignifiHealth’s prior written consent; (v) impersonates any person or entity, including any employee or representative of CompanyDignifiHealth; (vi) interferes with or attempt to interfere with the proper functioning of Company DignifiHealth Properties or uses Company DignifiHealth Properties in any way not expressly permitted by this Agreement; or (vii) attempts to engage in or engage in, any potentially harmful acts that are directed against Company DignifiHealth Properties, including but not limited to violating or attempting to violate any security features of Company DignifiHealth Properties, using manual or automated software or other means to access, “scrape,” “crawl” or “spider” any pages contained in Company DignifiHealth Properties, introducing viruses, worms, or similar harmful code into Company DignifiHealth Properties, or interfering or attempting to interfere with use of Company DignifiHealth Properties by any other user, host or network, including by means of overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” Company DignifiHealth Properties.
