Use of Information and Data. (a) Information and Data Collected by Yahoo. All information and data provided to Yahoo by users on the Yahoo Network or the Yahoo Foreign Properties or otherwise collected from users on the Yahoo Network or the Yahoo Foreign Properties by Yahoo will be retained and owned exclusively by Yahoo. Overture acknowledges that certain of that information and data may be related to the performance of the Overture Results (the “Overture Performance Data”). [*]. Use of Information and Data. Provider agrees that the proprietary methods and operations of Blue Shield and Health Plan, including, without limitation, the Administrative Requirements, contract terms, payment rates, levels of costs, utilization and revenues, software, data, functions, and the procedures, forms, and techniques for servicing accounts and Members, are highly confidential trade secrets of Blue Shield or Health Plan, as the case may be, and are entitled to protection as such. Provider agrees not to reveal such methods of operation to any other person or entity during the Term of, and after the termination of, this Agreement without the prior written consent of Blue Shield. For the purposes of the preceding sentence, proprietary methods of operation shall not include (i) those which are contained in printed publications available to the general public or (ii) those which are, or become, publicly known through no wrongful act or omission of Provider. Notwithstanding the foregoing, information and methods of operation of Blue Shield or Health Plan may be disclosed if required by Laws, by an Official Body, in connection with Provider's performance of its responsibilities under this Agreement, and/or where the well-being of the Member requires such disclosure; provided that Provider gives Blue Shield prompt written notice thereof of any such required disclosure.
Use of Information and Data. AGENCY acknowledges and agrees, on behalf of itself and its Constituents, that all information submitted by AGENCY to FORTE in order for FORTE to provide the Services to AGENCY or otherwise contributed by AGENCY pursuant to these Services (including Transaction results), is held in FORTE’s database and may be used by FORTE for the purpose of providing the Services to its customers in compliance with all applicable Laws and Rules, including in accordance with the federal Fair Credit Reporting Act (“FCRA”). Further, FORTE may track, review, compile, store and use any information or data received from AGENCY as part of a Transaction or information or data received from a Payment Association or financial institution regarding a Transaction for regulatory compliance or any other legally permissible purpose. Without limiting the foregoing, AGENCY agrees and acknowledges that FORTE may use the routing numbers, account numbers and other PII submitted by AGENCY as well as Transaction results provided to or received by FORTE for the purpose of supporting FORTE’s fraud detection, account validation and verification, and/or other commercially available services.
Use of Information and Data. The Service Provider acknowledges and agrees that the Principal may use and share data and information about the Service Provider provided through the Supplier Portal with Consumers and prospective Consumers and other interested parties including the adoption of any rating system regarding the performance and other relevant parameters of the Service Provider, and that the use and sharing of such data and information is integral to the Service Provider offering and providing the Services in accordance with this Agreement.

Provider further agrees, except as required by Laws or to the extent information is otherwise publicly available, not to utilize or disclose any information gathered or provided regarding the cost and utilization of health care services by Members (whether Member specific, account specific or aggregate) without the prior written consent of Blue Shield. Further, Provider will not disclose or permit the disclosure of any Member or group information derived from, through or provided by Blue Shield or Health Plan. Upon termination of this Agreement, Provider hereby agrees to immediately return all material related to Administrative Requirements including forms, policies, procedures, manuals and materials of every kind, if any, provided by Blue Shield or a Health Plan. Blue Shield may disclose the terms of this Agreement or provide a third party with a copy of this Agreement and information regarding terms of payment where a disclosure of terms is required for an audit.
Use of Information and Data. Merchant acknowledges and agrees, on behalf of itself and its customers, that all information submitted by Merchant to FORTE in order for FORTE to provide the Services to Merchant or otherwise contributed by Merchant pursuant to these Services (including Transaction results) is held in FORTE’s database, and may be used by FORTE or its affiliates for the purpose of providing the Services in compliance with all applicable Laws and Rules to its customers in compliance with all applicable Laws and Rules, including in accordance with the federal Fair Credit Reporting Act (“FCRA”). Further, FORTE may track, review, compile, store and use any information or data received from Merchant as part of a Transaction or from a Payment Association or financial institution regarding a Transaction for regulatory compliance or any other legally permissible purpose. Without limiting the foregoing, Xxxxxxxx agrees and acknowledges that FORTE (and/or certain of its affiliates) may use the routing numbers, account numbers and other PII submitted by Merchant as well as Transaction results provided to or received by FORTE for the purpose of supporting FORTE’s (or certain of its affiliates) fraud detection, account validation and verification, and/or other commercially available services.
Use of Information and Data. The Operator hereby represents and warrants irrevocably that it knows the Authority is granted the right to sue and publish, for any purpose, whether during the Engagement Period or thereafter, including towards future tenders conducted in connection with the Services subject of this Contract, all the data (including, without derogating from the generality of the aforementioned, financial and commercial data) that reaches its hands from the Operator and/or in connection with provision of the Services and/or in connection with the engagement with the Operator during the Engagement Period (including Extension Periods, if applicable), and the Operator hereby agrees in advance and irrevocably to any use or publication made by the Authority as aforementioned.

Use of Information and Data. H.22.7.2.1 The District agrees to maintain, and to cause its employees, agents or representatives to maintain on confidential basis information concerning the Provider’s relations and operations as well as any other information compiled or created by Provider which is proprietary to the Provider and which the Provider identifies as proprietary to the District in writing.
Use of Information and Data. The operator hereby states and warrants irrevocably, that he is informed of the Authority's right to make use and publish, for any purpose, whether during the term of the contract or thereafter, including as preparation for future tender to be held in relation to the services subject of this contract, all the data (including, without limitation of the aforesaid generality, financial and commercial data) which it will receive from the operator and / or in relation to the provision of services and / or in relation to the communications with the operator during the term of the contract (including an extension period, if any), and the operator hereby agrees in advance and irrevocably to any use or publication the Authority shall make as stated above.
