Common use of Standard of Performance Clause in Contracts

Standard of Performance. Consultant represents and warrants that it has the qualifications, experience and facilities necessary to properly perform the services required under this Agreement in a thorough, competent and professional manner. Consultant shall at all times faithfully, competently and to the best of its ability, experience and talent, perform all services described herein. Consultant shall at all times faithfully, competently and to the best of its ability, experience and talent, perform all services described herein. Consultant shall at all times faithfully, competently and to the best of its ability, experience and talent, perform all services described herein. In meeting its obligations under this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in providing services similar to those required of Consultant under this Agreementnature.

Consultant’s Services shall conform to applicable licensing requirements, competently industry standards, statutes, laws, acts, ordinances, and to the best of its ability, experience rules and talent, perform all services described herein. In meeting its obligations under this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in providing services similar to those required of Consultant under this Agreementregulations.

Consultant hereby covenants that it has shall follow the qualifications, experience and facilities necessary to properly perform the highest professional standards in performing all services required under this Agreement in a thorough, competent and professional manner. Consultant shall at all times faithfully, competently and to the best of its ability, experience and talent, perform all services described herein. In meeting its obligations under this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in providing services similar to those required of Consultant under this Agreementhereunder.

Consultant agrees to perform in a diligent, efficient, competent and facilities skillful manner commensurate with the highest standards of the profession, and to otherwise perform as is necessary to properly perform undertake the services required under this Agreement in a thorough, competent and professional manner. Consultant shall at all times faithfully, competently and to the best of its ability, experience and talent, perform all services described herein. In meeting its obligations under this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in providing services similar to those required of Consultant under this Agreement.

In meeting its obligations under this Agreement, Consultant shall employ, at quality observed by a minimum, generally accepted standards and practices utilized by persons engaged person practicing in providing services similar to those required of Consultant under this AgreementConsultant's profession.

The Consultant agrees to follow professional manner. In meeting its obligations under this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in applicable laws when providing services similar to those required of Consultant under this Agreementthe Services.

Standard of Performance. Consultant represents and warrants that it has the qualifications, experience and facilities necessary to properly shall perform the Services in a timely and professional manner in accordance with applicable professional standards consistent with that level of care and skill ordinarily exercised by other competent professionals with expertise in the type of services required under in this Agreement in a thorough, competent practicing under similar conditions at the same time and professional mannerlocality of the Project. Consultant shall at all times faithfully, competently and has represented to the best Authority that Consultant has expertise and experience in the type of its ability, experience services to be rendered hereunder and talent, perform all services described herein. In meeting its obligations under that such representation was a material inducement to the Authority to enter into this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in providing services similar to those required of Consultant under this AgreementAgreement with Consultant.
