Small Business Enterprise. (SBE) - A for-profit business that is independently owned and operated; that is not a subsidiary or franchise of another business and whose gross annual receipts do not exceed the amount set by the City Manager and that meets all other criteria set forth in regulations implementing Municipal Code Chapter 2, Article 2, Division 36. The City Manager shall review the threshold amount for SBEs on an annual basis and adjust as necessary to reflect changes in the marketplace. A business certified as a Micro Business (MB) or a Disabled Veteran Business Enterprise (DVBE) by the State of California and that has provided proof of such certification to the City Manager shall be deemed to be an SBE.
Small Business Enterprise. The County’s Division of Transportation has a Small Business Enterprise (SBE) Program as part of its DBE Program. The County provides race-neutral efforts to facilitate participation of small businesses in its procurement process for federally assisted projects through the FTA. Although there is no SBE goal for this procurement, SBE firms are encouraged to participate, and Offerors are encouraged to seek SBE firms as subconsultants/subcontractors.
Small Business Enterprise. If this Contract requires Small Business Enterprise participation in accordance with the Form A submitted by the Contractor in its bid or proposal, no less than the percentage of meaningful services indicated on the Form A must be performed by the firm or firms indicated on that Form. In the event the firm or firms listed on Form A are unable or unwilling to provide said services, Contractor shall contact the City’s Office of Equity and Inclusion (OEI) and work with OEI to engage a replacement(s). If any document submitted by Contractor requesting certification as a Small Business Enterprise for the purpose of participating in any City contract contains false, misleading or fraudulent information, City may direct the imposition of any of the following sanctions on Contractor in its sole discretion: (a) withholding of payment, (b) termination, suspension or cancellation of the Contract in whole or in part, and/or (c) a denial to participate in any further contracts awarded by City for a period of one (1) year after the first (1st) violation is found and for a period of three (3) years after any subsequent violations are found. Small Business Enterprise. In connection with the performance of this Agreement, City will cooperate with Authority in meeting all applicable federal regulations with regard to the maximum utilization of disadvantaged business enterprises, and will use its best efforts to ensure that small business enterprises shall have the maximum practicable opportunity to compete for subcontract work under this Agreement.

Small Business Enterprise. The Operator shall at all times comply with the requirements of the County's Small Business Enterprise Program. In compliance with applicable requirements, the Operator shall deliver proposed contract and design and construction packages to the Small Business Division of the Internal Services Department of the County ("SBD") for a recommendation (which shall be made in consultation with the Operator) to the County Mayor of the Small Business Enterprise subcontractor goals applicable to such design and construction. The County Mayor shall establish the Applicable Measures upon receipt of the recommendation of the SBD. The Operator shall include the Applicable Measures in design and construction documents, as applicable, and shall adhere to those Applicable Measures in design and construction activities. The Operator shall incorporate in all design and development contracts the prompt payment provisions contained in Applicable Law with respect to Small Business Enterprises. The Operator agrees to include in construction contracts a prohibition against imposing any requirements against Small Business Enterprises that are not customary, not otherwise required by law, or which impose a financial burden that intentionally impact Small Business Enterprises. The Operator shall comply with the Small Business Enterprise requirements during all phases of construction of the Operator’s Project. Should the Operator fail to comply with any of the Small Business Enterprise requirements, the Operator shall be obligated to make up such deficit in future phases of construction of the Operator’s Project.
