Common use of Since December Clause in Contracts

Since December. 31, 1999, both immediately before and after giving effect to the consummation of the transactions contemplated by this Agreement, there shall not have occurred any Material Adverse Change or any event, condition or state of facts that could reasonably be expected to result in a Material Adverse Change.

Since December. 31, 19991997, both immediately before and after giving effect to the consummation of the transactions contemplated by this Agreement, there shall not have occurred any Material Adverse Change or any event, condition or state of facts that could reasonably be expected to result in a Material Adverse Change.

Since December. 31, 19991998, both immediately before and after giving effect to the consummation of the transactions contemplated by this Agreement, there shall not have occurred any Material Adverse Change with respect to either Borrower or any event, condition or state of facts that could is reasonably be expected likely to result in a Material Adverse ChangeChange with respect to either Borrower.

Since December. 31, 19992000, both immediately before and after giving effect to the consummation of the transactions contemplated by this Agreement, there shall not have occurred any Material Adverse Change with respect to the Borrower or any of its Subsidiaries or any event, condition or state of facts that could reasonably be expected to result in a Material Adverse ChangeChange with respect to the Borrower or any of its Subsidiaries.
