Common use of Section IV Clause in Contracts

Section IV. I.(1) above will not apply if the relevant person or enterprise acquires a business or product line that manufactures or sells Competitive Products after the commencement of the Executive's employment or other relationship with such person or enterprise and the Executive does not participate in any way in the business of the Competitive Products for 36 months after the termination of the Executive's employment and, at the request of the Company, the Executive and the relevant person or enterprise certify to the Company in writing that the Executive has and will comply with the restrictions of this Section IV.I.(3).

Section IV. I.(1) above will not apply if the relevant person or enterprise acquires a business or product line that manufactures or sells Competitive Products after the commencement of the Executive's employment or other relationship with such person or enterprise and the Executive does not participate in any way in the business of the Competitive Products for 36 24 months after the termination of the Executive's employment and, at the request of the Company, the Executive and the relevant person or enterprise certify to the Company in writing that the Executive has and will comply with the restrictions of this Section IV.I.(3).
