Sales and Purchase. Subject to the terms and conditions of ------------------ this Agreement, HYSEQ shall sell to XXXXXX-XXXXX and XXXXXX-XXXXX shall purchase CHIPS from HYSEQ. Prior to the first commercial sale of CHIPS, the parties will develop and enter into a purchase agreement that will govern the purchase and sale of CHIPS by HYSEQ to XXXXXX-XXXXX.
