Required Court Appearance. One (1) day of absence per year with pay will be allowed for an employee to appear as a witness in court, as a litigant, or to respond to an official order from another governmental jurisdiction for reasons not brought about through the connivance or misconduct of the employee. The exception is to be made if the employee is acting in the capacity of witness at the request of the District legal counsel on behalf of the District. In such instances, the employee will be treated as if on paid status (i.e., as if attending a workshop).

Compensation received for such court appearances shall be turned in to the Business Office if such pay is earned during the contractually defined day of service for that Bargaining Unit Member. Travel expenses, however, shall be retained by the Bargaining Unit Member. Full-time Bargaining Unit Members shall return to their working assignments during a day of service when their presence in court is no longer required.

Required Court Appearance. An employee shall receive their regular compensation when required to appear in any court in connection with an employee’s officially assigned duties, provided that the requirement to appear in court is as a result of a subpoena filed on behalf of the City. The period of such authorized absence shall include the time required for travel to the court and return to the employee’s work site or the City of Xxxxxxx, whichever is appropriate. An employee may use vacation or compensatory time for required court appearances not related to city work.
Required Court Appearance. Required court appearances in connection with an employee’s assigned duties, including the time required to travel to the court and return to the employee’s headquarters shall be considered as hours worked. Any overtime resulting from such appearances shall be governed by Article 13, Compensation. Any fee paid to such an employee shall be paid to the General Fund of the County (mileage reimbursement excluded unless a County vehicle was used).

  • Appearance in Court When an employee is required by the Employer to appear in any court or before any attorney for the purpose of testifying because of any accident he/she may have been involved in during working hours, the employee shall be reimbursed in full by the Employer for all time spent or hours of work lost, computed at his/her current hourly rate of pay, whichever is greater, because of his/her appearance.
