Release of Drug Testing Information. The MRO shall inform the employee before beginning the verifica- tion interview, that the MRO could transmit to appropriate parties information concerning medications being used by the employee or the employee’s medical condition only if, in the MRO’s medical judgment, the information indicated that the employee may be med- ically unqualified under applicable DOT agency rules. When a grievance is filed as a result of a positive test the Employer shall obtain from the laboratory its records relating to the drug test. Upon receiving the records, the Employer shall provide copies to the appropriate official of the Union, by the end of the following business day after receiving the documents from the laboratory or the MRO, as applicable, provided that the employee has executed written consent authorizing release to the Union, a copy of which must be provided to the Employer. The Company agrees to notify the Union of any change of HHS approved laboratories used for drug testing, for whatever reason.
