However, this raises the question as to whether the collection of real time position information could lead to employee tracking (PP2), if such data were linked with coach driver data. ▪ PP1 - Handling delays, breakdowns and accidents [3] This purpose is legitimate and data collected in order to achieve it can be considered as adequate, relevant and not excessive. The recipients of data are restricted to EUR-CS and EUR-OP, users handling delays, breakdowns and accidents. The duration of storage has to be short: once the consequences of the delay, the breakdown or the accident have been handled, there is no valid reason to store the data for a longer period. Coach drivers have to be informed of this processing, even if they are not directly the data subjects. ▪ PP2 - Employee tracking [4] This need has not been expressed so far; however, we present a quick overview of the rules to be applied. Even in case where the processing of data related to employees is legitimate, it is always deemed to be sensitive. Very frequent updates (every minute) can be considered as too excessive in relation to the pursued purpose. Moreover, the recipients have to be restricted to coach driver management and, possibly, to Human Resources Departments. Collection of other data, like speed data, could be restricted or forbidden. Coach drivers have to be informed of the processing and their right of access and to a certain extent, labour law rules can be applicable.
