Common use of Priority of Agreement Clause in Contracts

Priority of Agreement. 15. The Owners hereby agree that if at the time of registration of this Agreement there are any encumbrances on the title to the Lands held by any party other than the Township, then the Owners shall arrange for the discharge of such encumbrances from title. In the alternative, the Owners shall, prior to the registration of this Agreement, obtain a postponement and consent in favour of the Township for each encumbrance to this Agreement’s priority on title of the Lands.
