  • Credit Union Liability If we do not properly complete a transaction according to this Agreement, we will be liable for your losses or damages not to exceed the amount of the transaction, except as otherwise provided by law. We will not be liable if: (1) your account contains insufficient funds for the transaction; (2) circumstances beyond our control prevent the transaction; (3) your loss is caused by your or another financial institution's negligence; or (4) your account funds are subject to legal process or other claim. We will not be liable for consequential damages, except liability for wrongful dishonor. We exercise ordinary care if our actions or nonactions are consistent with applicable state law, Federal Reserve regulations and operating letters, clearinghouse rules, and general financial institution practices followed in the area we serve. You grant us the right, in making payments of deposited funds, to rely exclusively on the form of the account and the terms of this Agreement. Any conflict regarding what you and our employees say or write will be resolved by reference to this Agreement.

  • Notice of Union Representative Visits The Union shall inform the Company when any representative of the Union intends to visit the worksite for the purpose of conducting Union business. Such visits will not disrupt employees working without the supervisor/manager’s permission.

  • Electronic Notice to Borrower Unless another delivery method is required by Applicable Law, Lender may provide notice to Borrower by e-mail or other electronic communication (“Electronic Communication”) if: (i) agreed to by Xxxxxx and Xxxxxxxx in writing; (ii) Borrower has provided Lender with Borrower’s e-mail or other electronic address (“Electronic Address”); (iii) Lender provides Borrower with the option to receive notices by first class mail or by other non-Electronic Communication instead of by Electronic Communication; and (iv) Lender otherwise complies with Applicable Law. Any notice to Borrower sent by Electronic Communication in connection with this Security Instrument will be deemed to have been given to Borrower when sent unless Lender becomes aware that such notice is not delivered. If Xxxxxx becomes aware that any notice sent by Electronic Communication is not delivered, Xxxxxx will resend such communication to Borrower by first class mail or by other non-Electronic Communication. Xxxxxxxx may withdraw the agreement to receive Electronic Communications from Lender at any time by providing written notice to Xxxxxx of Xxxxxxxx’s withdrawal of such agreement.

  • Emergency Call Out A call‐out shall occur when supervisory personnel specifically require an employee to perform emergency work outside the regular scheduled hours. All employees shall be paid two (2) times the regular rate of pay for all time worked during a call‐out for a minimum of two (2) hours up to a maximum of three (3) hours. All additional time worked over the three (3) hours emergency call‐out shall be at the regular overtime rate of pay of the employee. Anytime an employee on standby is monitoring the work of others they shall receive emergency call‐out pay.
