Common use of Not Assignable Clause in Contracts

Not Assignable. Neither this Agreement nor any right of Borrower to receive any sums, proceeds or disbursements hereunder, or under the Note may be assigned, pledged, hypothecated, anticipated or otherwise encumbered by Borrower without the prior written consent of Lender. Subject to the foregoing restrictions, this Agreement shall inure to the benefit of Lender, its successors and assigns and bind Borrower, its heirs, executors, administrators, successors and assigns.

Not Assignable. Neither this Agreement nor any right rights of Borrower to receive any sums, proceeds or disbursements hereunder, under this Agreement or under the Note may be assigned, pledged, hypothecated, anticipated hypothecated or otherwise encumbered by Borrower Borrower, without the prior written consent of LenderAgent and Lenders. Subject to the foregoing restrictions, this Agreement shall inure to the benefit of LenderAgent and Lenders, its successors and assigns assigns, and shall bind Borrower, Borrower and its permitted heirs, executors, administrators, successors and assigns.

Neither this Agreement agreement nor any right of Borrower to receive any sums, proceeds or disbursements hereunder, or under the Note may be assigned, pledged, hypothecated, anticipated or otherwise encumbered by Borrower without the prior written consent of LenderBank. Subject to the foregoing restrictions, this Agreement agreement shall inure to the benefit of LenderBank, its successors and assigns and bind Borrower, its heirs, executors, administrators, successors and assigns.

Subject to the foregoing restrictions, this Agreement shall inure to the benefit of Lender, its Borrower and their respective successors and assigns assigns, and shall bind Borrower, its Lender and Borrower and their respective permitted heirs, executors, administrators, successors and assigns.
