Non-Standard Equipment. If dedicated or specialized equipment is required to Process Product for Omeros, Hospira shall specify such equipment to Omeros in writing and, if Omeros agrees in writing that such equipment is required, Omeros shall reimburse Hospira for † DESIGNATES PORTIONS OF THIS DOCUMENT THAT HAVE BEEN OMITTED PURSUANT TO A REQUEST FOR CONFIDENTIAL TREATMENT FILED SEPARATELY WITH THE COMMISSION the cost of purchasing such equipment, on a pass-through basis, as well as the reasonable cost of installation and validation of such equipment, all subject to Omeros’ prior written approval or a separate written agreement between the Parties with respect to such equipment purchase, installation and validation. Title to such equipment shall be in Omeros’ name and, at Omeros’ request and reasonable expense, shall be returned to Omeros or discarded upon termination of this Agreement. If Hospira wishes to use such equipment for Processing of a product other than Product for Omeros, Hospira and Omeros shall meet and discuss the technical and practical ramifications of such use and appropriate compensation to Omeros, but in no event is Omeros obligated to allow the use of such equipment for the manufacture of such other product. These provisions shall not apply to any non-dedicated or non-specialized equipment normally used or required for the manufacture of pharmaceutical products, or to additional non-dedicated or non-specialized equipment required to increase production capacity or efficiency at Hospira’s Facility.

Non-Standard Equipment. The Lease is hereby amended to add the following new paragraph under Section 7,2 of the Lease:
Non-Standard Equipment. Notwithstanding anything to the contrary contained in this Lease, Tenant shall be solely responsible for the maintenance, repair and replacement of any non-standard equipment and systems used at the Premises (“Non-Standard Equipment”), including, without limitation, separate dedicated air conditioning units and equipment serving computer, telecommunication and other intellectual or information technology items. In no event shall Landlord or its property management company be responsible for the maintenance, repair or replacement of any Non-Standard Equipment or for any damages arising out of the malfunction, failure or break down thereof for any reason whatsoever. In addition, Tenant shall pay, on a monthly basis, any electrical costs attributable to above standard or after-hours usage of its Non-Standard Equipment. As of the Commencement Date, the Non-Standard Equipment servicing Tenant’s IT room is a 1.5 ton mini-split that is being utilized by Tenant 24 hours a day/7 days a week. Tenant agrees to pay for the above-standard or after-hours usage of such Non-Standard Equipment as reasonably estimated by Landlord which, as of the Commencement Date, is $50.00 per month/per ton or a total of $75.00 per month (plus any related sales tax thereon).
Non-Standard Equipment. In the event Tenant’s use of the Leased Premises includes the use of existing, or the installation of any new machines, equipment, or devices in the Leased Premises that do not constitute standard office equipment provided or available to all tenants of the Building, including, without limitation, refrigerators, dishwashers, garbage disposals, air conditioning units, heating units, computers, water heaters, and such other machines, equipment, or devices ("Non-Standard Equipment"), the maintenance, repair and replacement of all such Non-Standard Equipment located in the Leased Premises, regardless of whether such Non-Standard Equipment existed in the Leased Premises on the Commencement Date or such Non-Standard Equipment was placed in the Leased Premises after the Commencement Date, shall be made by Tenant at Tenant’s sole cost and expense. In the event Tenant fails to maintain, repair or replace any Non-Standard Equipment located in the Leased Premises, after ten (10) days written notice of such failure from Landlord, Landlord shall have the option (but not the obligation) to enter the Leased Premises to undertake the necessary maintenance, repairs or replacements of such Non-Standard Equipment and Tenant shall reimburse Landlord for all of Landlord’s costs and expense incurred in such maintenance, repair or replacement as Additional Rent.

Non-Standard Equipment. (1) Customer may request that Contour manage or support hardware and/or software products for which Contour does not typically provide support as part of the Infrastructure Management Services (collectively, “Non-Standard Equipment”). Contour may manage or provide support for Non-Standard Equipment at its discretion. Contour shall not be responsible for any service levels in connection with Non-Standard Equipment, and Customer shall not be eligible for credits under this Addendum for the failure of any Non-Standard Equipment.

  • Additional Equipment Additional Equipment may from time to time be added as the subject matter of this Agreement as agreed on by the parties. Any additional property will be added in an amendment describing the property, the monthly rental, security deposit, and stipulated loss value of the additional Equipment. All amendments must be in writing and signed by both parties. Other than by this amendment procedure, this Agreement may not be amended, modified, or altered in any manner except in writing signed by both parties.

  • Leased Equipment The risk of loss or damage to leased equipment, goods or property shall not transfer to the University except as provided in §680.219, Florida Statutes. Any security interest in the leased equipment, goods or property granted to the Contractor contrary to AGO 79-72 and AGO 80-9 is null and void. Limitations of remedies provisions, which are unconscionable under applicable Florida law, are void. MATERIAL SAFETY DATA SHEET (MSDS). In compliance with Florida Statutes, Ch. 442, a Material Safety Data Sheet (MSDS) must accompany any applicable item delivered under this Agreement.

  • Supplies and Equipment The Union and employees will not use state-purchased supplies or equipment to conduct union business or representational activities.
