MANAGEMENT RIGHTS AND CONTRACT TERMS. The President/Chief Executive Officer or his/her designee to have the right to run the Hospital, to set policy, to direct the work force, to assign work, to hire, fire, suspend, transfer, classify or assign employees for economic, administrative or other reasons, it being understood that the specific provisions of the Agreement, as they apply to the wages, hours and other terms and conditions of employment of persons covered by this Agreement, shall govern the appropriateness of action by the President/Chief Executive Officer or his/her designee.

  • Agreement Terms and Conditions 2.01 This Agreement is for a space in the JCU housing system, and covers the entire academic year (both Fall and Spring semesters), or any portion of the academic year remaining at the time this Agreement is signed. Residence in JCU residence halls requires participation in JCU’s residential dining program. The Student will be assessed all fees for the agreement term if the Student enrolls but does not occupy the assigned space and does not have approval of this Agreement cancelled in writing pursuant to 14.04.

  • MANAGEMENT RIGHTS AND RESPONSIBILITIES The Employer through its designated management personnel or agents has the right and responsibility, except as expressly modified by this Agreement, to control, change, and supervise all operations and to direct and assign work to all working forces. Such rights and responsibilities shall include by way of illustration but shall not be limited to: the selection and hiring, training, discipline and discharge, classification, reclassification, layoff, promotion and demotion or transfer of employees; the establishment of work schedules; the allocation of all financial and other resources; the control and regulation of the use of all equipment and other property of the Employer. The Employer shall determine the methods, technological means and qualifications of personnel by and for which operations are to be carried out. The Employer shall take whatever action as may be necessary to carry out its rights in any emergency situation. Application of this Article shall not preclude the use of the grievance procedure as established in this Agreement.

  • ACCEPTANCE OF CONTRACT/TERMS AND CONDITIONS (a) This Contract integrates, merges, and supersedes any prior offers, negotiations, and agreements concerning the subject matter hereof and constitutes the entire agreement between the parties.
