Common use of Management Certifications Clause in Contracts

Management Certifications. In addition to the responsibilities set forth in this CIA for all Covered Persons, certain KRHS employees (Certifying Employees) are specifically expected to monitor and oversee activities within their areas of authority and shall annually certify that the applicable KRMC, HC, and NOSM department is in compliance with applicable Federal health care program requirements and with the obligations of this CIA. These Certifying Employees shall include, at a minimum, the following: Executive Vice President and Chief Financial Officer of KRH, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, Chief Executive Officer of HC, Executive Vice President and Chief Medical Officer of KRH, and Executive Vice President and Chief Strategy Officer or KRH. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of [insert name of entity] is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

Management Certifications. These Certifying Employees shall include, at a minimum, the following: Executive Vice President and Chief Financial Officer of KRHManaging Partner, Executive Vice President and Chief Information Officer of KRHthe practice manager, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, Chief Executive Officer of HC, Executive Vice President and Chief Medical Officer of KRHthe billing manager, and Executive Vice President and Chief Strategy Officer or KRHall non-managing partners. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] Xxxxxx Valley policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of [insert name of entity] Xxxxxx Valley is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

Management Certifications. In addition to the responsibilities set forth in this CIA for all Covered Persons, certain KRHS Liberty employees (Certifying Employees) are specifically expected to monitor and oversee activities within their areas of authority and shall annually certify that the applicable KRMC, HC, and NOSM Liberty department is in compliance with applicable Federal health care program requirements and with the obligations of this CIA. These Certifying Employees shall include, at a minimum, the following: Executive Vice  President and Chief Financial Officer of KRH, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and  Chief Operating Officer of KRH, Executive  Vice President and  Director of Operations  Public Relations/Community Liaison  Billing Manager  Chief Nursing Officer of KRHOperations states:  Director of Training, Executive Vice President of Ambulatory for KRH, Chief Executive Officer of HC, Executive Vice President and Chief Medical Officer of KRHSafety, and Executive Vice President and Chief Strategy Officer or KRH. Risk Management For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] Liberty policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of [insert name of entity] Liberty is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

Management Certifications. In addition to the responsibilities set forth in this CIA for all Covered Persons, certain KRHS Avanti employees (Certifying Employees) are specifically expected to monitor and oversee activities within their areas of authority and shall annually certify that the applicable KRMC, HC, and NOSM Avanti department is in compliance with applicable Federal health care program requirements and with the obligations of this CIA. These Certifying Employees shall include, at a minimum, the followingfollowing for Gardena Hospital, L.P.: Chief Executive Vice President Officer, Chief Financial Officer, Patient Care Services Director/Manager, Chief Nursing Officer, and Associate Administrator. These Certifying Employees shall also include, at a minimum, the following for Avanti Hospitals, LLC: Chief Executive Officer, Chief Financial Officer, Chief Medical Officer, and Chief Financial Officer of KRH, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, Chief Executive Officer of HC, Executive Vice President and Chief Medical Officer of KRH, and Executive Vice President and Chief Strategy Officer or KRHCompliance Officer. For each Reporting Period, each Certifying Employee shall sign a certification that states: “"I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] Avanti policies, and I have taken steps to promote such compliance. These Certifying Employees shall include, at a minimum, the following: Chief Executive Vice President and Officer; Chief Operating Officer; Chief Financial Officer Officer; Administrator; and Director of KRH, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, Chief Executive Officer of HC, Executive Vice President and Chief Medical Officer of KRH, and Executive Vice President and Chief Strategy Officer or KRHMarketing. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] PCMC policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of [insert name of entity] PCMC is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

Management Certifications. In addition to the responsibilities set forth in this CIA for all Covered Persons, certain KRHS GIS Parties employees (Certifying Employees) are specifically expected to monitor and oversee activities within their areas of authority and shall annually certify that the applicable KRMC, HC, and NOSM GIS Party’s department is in compliance with applicable Federal health care program requirements and with the obligations of this CIA. These Certifying Employees shall include, at a minimum, include the following: Executive Vice President the GIS Medical Director, the GIS Secretary, the GIS Managing Partner, the GIS Practice Administrator, the GIS Human Resources and Chief Financial Officer of KRHPayroll Director, Executive Vice President the GIS Accounts Payable Director, the GIS Billing Supervisor, the GIS Clinical Manager, the GIDE and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, Chief Executive Officer of HC, Executive Vice President and Chief Medical Officer of KRHDCAD Managing Partner(s), and Executive Vice President the GIDE and Chief Strategy Officer or KRHDCAD Clinical Director(s). For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] the GIS Parties’ policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of [insert name of entityGIS/GIDE/DCAD] is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

Management Certifications. In addition to the responsibilities set forth in this CIA for all Covered Persons, certain KRHS Xxxxxxxxxx-Xxxxxxx Xxxxxx employees (Certifying Employees) are specifically expected to monitor and oversee activities within their areas of authority and shall annually certify that the applicable KRMC, HC, and NOSM Xxxxxxxxxx-Xxxxxxx Xxxxxx department is in compliance with applicable Federal health care program requirements Xxxxxxxxxx–Zwanger Xxxxxx – Corporate Integrity Agreement and with the obligations of this CIA. These Certifying Employees shall include, at a minimum, the following: Chief Executive Vice President and Officer, Chief Operating Officer, Chief Financial Officer of KRHOfficer, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRHBilling, Chief Executive Officer of HC, Executive Vice President and Chief Medical Officer of KRHOperations, and Executive Vice President all other members of senior management and Chief Strategy Officer the leaders of all business units, divisions or KRHdepartments with operations that relate to the Federal health care programs. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] Xxxxxxxxxx-Xxxxxxx Xxxxxx policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of [insert name of entity] Xxxxxxxxxx-Xxxxxxx Xxxxxx is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. These Certifying Employees shall include, at a minimum, the following: Executive Vice President and Chief Financial Officer of KRH, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, the Chief Executive Officer of HCOfficer, Executive Vice President and Chief Medical Officer of KRHthe President, the Billing Manager, and Executive Vice President and Chief Strategy Officer or KRHthe Director of Operations. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] Balboa policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of [insert name of entity] Balboa is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement. I understand that this certification is being provided to and relied upon by the United States.” If any Certifying Employee is unable to provide such a certification, the Certifying Employee shall provide a written explanation of the reasons why he or she is unable to provide the certification outlined above.

These Certifying Employees shall include, at a minimum, the following: Executive Vice President and Chief Financial Officer of KRH, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, the Chief Executive Officer of HCOfficer, Executive Vice President and Chief Medical Officer of KRHDirector, and Executive Vice President and Chief Strategy Officer or KRHAdministrator. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. These Certifying Employees shall include, at a minimum, the following: Executive Vice President Administrator, Director of Financial Services and Chief Financial Officer Human Resources, Director of KRH, Executive Vice President and Chief Information Officer of KRH, Executive Vice President and Chief Operating Officer of KRH, Executive Vice President and Chief Nursing Officer of KRH, Executive Vice President of Ambulatory for KRH, Chief Executive Officer of HC, Executive Vice President and Chief Medical Officer of KRHBusiness Services, and Executive Vice President and Chief Strategy Officer or KRHthe Director of Clinical Services. For each Reporting Period, each Certifying Employee shall sign a certification that states: “I have been trained on and understand the compliance requirements and responsibilities as they relate to [insert name of department], an area under my supervision. My job responsibilities include ensuring compliance with regard to the [insert name of department] with all applicable Federal health care program requirements, obligations of the Corporate Integrity Agreement, and [insert name of entity] Toccoa policies, and I have taken steps to promote such compliance. To the best of my knowledge, the [insert name of department] of [insert name of entity] Toccoa is in compliance with all applicable Federal health care program requirements and the obligations of the Corporate Integrity Agreement.
