Common use of Maintenance of Property Clause in Contracts

Maintenance of Property. The Company shall maintain, and shall cause each Subsidiary to maintain, and preserve all its property which is used or useful in its business in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof except where the failure to do so could not reasonably be expected to have a Material Adverse Effect.

Maintenance of Property. The Company shall maintainwill, and shall will cause each Subsidiary to maintainto, keep and preserve maintain all its property which is used of the material Properties necessary or useful in its their business taken as a whole in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto material renewals, replacements, additions, betterments and renewals improvements thereto; provided, however, that nothing in this Section shall prevent the Company or any Subsidiary from discontinuing the operating and replacements thereof except where maintenance of any of its Properties if such discontinuance is, in the failure judgment of the Company, desirable in the conduct of its business and not disadvantageous in any material respect to do so could not reasonably be expected to have a Material Adverse Effectthe Banks as holders of the Notes.

The Company shall maintain, and shall cause each Restricted Subsidiary to maintain, and preserve all its property which is used or useful in its business in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof except where the failure to do so could not reasonably be expected to have a Material Adverse Effect. The Company and each Restricted Subsidiary shall use the standard of care typical in the industry in the operation and maintenance of its Facilities.

Maintenance of Property. The Company shall maintain, and shall cause each Significant Subsidiary to maintain, and preserve all its property which is used or useful in its business in good working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof except where the failure to do so could not reasonably be expected to have a Material Adverse Effect.

Maintenance of Property. The Company shall maintainwill, and shall will cause each Material Subsidiary to, do all things necessary to maintain, preserve, protect and preserve all keep its property which is used or useful in its business Property in good repair, working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto and proper repairs, renewals and replacements thereof so that its business carried on in connection therewith may be properly conducted at all times, except where the failure to do so maintain, preserve, protect and repair could not reasonably be expected to have a Material Adverse Effect.

The Company and each Subsidiary shall use the standard of care typical in the industry in the operation and maintenance of its facilities.

The Company shall maintain, and shall cause each Subsidiary to maintain, and preserve all its property which is used or useful in its business in good repair and working order and condition, ordinary wear and tear excepted and make all necessary repairs thereto and renewals and replacements thereof so that its business carried on in connection therewith may be properly conducted, unless the Company determines in good faith that the continued maintenance of any specific property is no longer economically desirable and except where the failure to do so for non-maintenance of any specific property which could not be reasonably be expected to have a Material Adverse Effect.
