Location of Nonconformance occurred. Detected at Supplier When non-conformance is detected, the supplier is expected to determine the extent of the problem and take prompt action to correct the condition and prevent the shipment of all non-conforming material. The supplier should notify Xxxxx of any “use as is” or “repair” non-conformances to the requirements of the Xxxxx Purchase Order. “Use as is” and “repair” dispositions should be submitted to Xxxxx prior to implementation, and further work should not be performed until directed by Xxxxx. Supplier should immediately notify the appropriate Xxxxx Sourcing team member of record of any suspected quality problems in shipments already released and the corrective action being taken to eliminate the quality problem in the future. These costs include, but are not limited to, material, shipping, handling, Xxxxx direct and indirect labor, and contracted services.   • Certification of Funds; Budget and Fiscal Provisions; Termination in the Event of Non-Appropriation This Agreement is subject to the budget and fiscal provisions of the City’s Charter. Charges will accrue only after prior written authorization certified by the Controller, and the amount of City’s obligation hereunder shall not at any time exceed the amount certified for the purpose and period stated in such advance authorization. The Contractor must provide the Department or Customer with a corrective action plan describing how the Contractor will address all issues of contract non-performance, unacceptable performance, and failure to meet the minimum performance levels, deliverable deficiencies, or contract non-compliance.

  • Independence from Material Breach Determination Except as set forth in Section X.D.1.c, these provisions for payment of Stipulated Penalties shall not affect or otherwise set a standard for OIG’s decision that CHSI has materially breached this CIA, which decision shall be made at OIG’s discretion and shall be governed by the provisions in Section X.D, below.
