Legal Duty. 1. In the event that a certified employee of the Sheffield-Sheffield Lake Schools, not suing the Board is subpoenaed to appear in court as a witness, said employee shall receive full pay for this service. Time taken for this service shall not be charged against sick leave, personal leave and/or accrued leave. Certified employees who are suing the Board or are involved in personal legal action will not be granted legal duty leave for any court time taken during the employee’s normal workday. The employee shall use available personal and/or accrued days.

Legal Duty. I. A teacher called for jury duty will be compensated for the difference between the teacher pay and the pay received for the performance of such obligation.
Legal Duty. A teacher, who serves on jury duty or appears for summons or subpoena, which neither summons nor subpoena is for either personal or family issues, shall be granted the day or days necessary to discharge this responsibility. The District shall continue to pay the teachers their regular rate of pay for those days. The teachers will remit to the District the legal duty pay they received. Legal duty pay shall not include mileage and/or per diem allowances.
Legal Duty. Employees required by law to appear for jury duty or other legal obligation shall suffer no financial loss because of such absence, and the difference between their normal salary and the compensation received for jury duty shall be paid to the employee by the Board. Employees, when excused from jury duty, shall return to work unless excused by the Principal.

Use of this leave may not be for personal or family issues, or apply to cases initiated by the teacher or the teacher organizations against the District. Family is defined as spouse, children, adopted children, parents, siblings, parent’s of the teacher’s spouse, step children and people for whom the teacher is a conservator or guardian or domestic partner (as defined in Article III Section 5).

A teacher who is subpoenaed to testify before a judicial tribunal or governmental body shall be compensated for the difference between the teacher’s pay and the pay received for the performance of such obligation. This paragraph shall not be applicable to situations when the teacher has an interest in the proceedings adverse to the Northwest Indiana Special Education Cooperative’s interest or when the teacher is testifying in a proceeding which is for the personal benefit of the teacher.
