Common use of Insurance Provisions Clause in Contracts

Insurance Provisions. The policies are to contain, or be endorsed to contain, the following provisions: • The City, its officers, officials, employees, agents and volunteers (each an “additional insured”) are to be covered as insureds with the same coverage and limits available to the named insured regarding: liability arising out of activities performed by or on behalf of the Consultant; premises owned, occupied or used by the Consultant; or automobiles owned, leased, hired or borrowed by the Consultant. The coverage shall contain no special limitations on the scope of the protection afforded to the City, its officers, officials, employees, agents or volunteers. Any available insurance proceeds broader than or in excess of the minimum insurance coverage requirements and/or limits specified in this agreement shall be available to the additional insured. The requirements for coverage and limits shall be (1) the minimum coverage and limits specified in this agreement; or (2) the broader coverage and maximum limits of coverage of any insurance policy or proceeds available to the named insured; whichever is greater. The additional insured coverage under Consultant’s policy shall be ''primary and non-contributory" and will not seek contribution from the City’s insurance or self-insurance and shall be at least as broad as CG 20 01 04 13.
