Goods Wholly Produced or Obtained. For the purposes of Article 2.1(a) (Originating Goods), the following goods shall be considered as wholly produced or obtained:

Goods Wholly Produced or Obtained. For the purposes of Article 2.1(a) (Originating Goods), the following goods shall be considered as wholly produced or obtained: plants and plant goods, including fruit, flowers, vegetables, trees, seaweed, fungi and live plants, grown, harvested, picked, or gathered in a Party1; live animals born and raised in a Party; goods obtained from live animals in a Party; goods obtained from hunting, trapping, fishing, farming, aquaculture, gathering, or capturing in a Party; minerals and other naturally occurring substances extracted or taken from the soil, waters, seabed or beneath the seabed in a Party; goods of sea-fishing and other marine goods taken from the high seas, in accordance with international law2, by any vessel registered or recorded with a Party and entitled to fly the flag of that Party; goods produced on board any factory ship registered or recorded with a Party and entitled to fly the flag of that Party from the goods referred to in Subparagraph (f); goods taken by a Party, or a person of a Party, from the seabed or beneath the seabed beyond the Exclusive Economic Zone and adjacent Continental Shelf of that Party and beyond areas over which third parties exercise jurisdiction under exploitation rights granted in accordance with international law3; goods which are: waste and scrap derived from production and consumption in a Party provided that such goods are fit only for the recovery of raw materials; or used goods collected in a Party provided that such goods are fit only for the recovery of raw materials; and goods produced or obtained in a Party solely from products referred to in Subparagraphs (a) to (i) or from their derivatives.

  • Wholly Obtained or Produced Goods For purposes of Article 3.1.1(a), the following goods are wholly obtained or produced entirely in the territory of one or both of the Parties: (a) live animals born and raised in the territory of Korea or Peru; (b) goods obtained from live animals born and raised in the territory of Korea or Peru; (c) goods obtained by hunting, trapping, fishing, or aquaculture in the territory of Korea or Peru1; (d) goods of sea-fishing and other goods taken from the sea outside the territory of a Party by vessels registered or recorded with a Party and flying its flag; (e) goods produced on board factory ships, exclusively from the goods referred to in subparagraph (d), provided that such factory ships are registered or recorded with a Party and fly its flag; (f)

  • REPAIRED OR REPLACED PRODUCTS, PARTS, OR COMPONENTS Where the Contractor is required to repair, replace or substitute Product or parts or components of the Product under the Contract, the repaired, replaced or substituted Products shall be subject to all terms and conditions for new parts and components set forth in the Contract including warranties, as set forth in the Warranties clause herein. Replaced or repaired Product or parts and components of such Product shall be new and shall, if available, be replaced by the original manufacturer’s component or part. Remanufactured parts or components meeting new Product standards may be permitted by the Commissioner or Authorized User. Before installation, all proposed substitutes for the original manufacturers’ installed parts or components must be approved by the Authorized User. The part or component shall be equal to or of better quality than the original part or component being replaced.

  • Sale or License of Custom Products Involving Tax Exempt Financing (i.e., Certificates of Participation - COPS) The Authorized User’s sale or other transfer of Custom Products which were acquired by the Authorized User using third party, tax-exempt financing may not occur until such Custom Products are, or become, useable. In the event that the Contractor wishes to obtain ownership rights to Custom Product(s), the sale or other transfer shall be at fair market value determined at the time of such sale or other transfer, and must be pursuant to a separate written agreement in a form acceptable to the Authorized User which complies with the terms of this paragraph.

  • REPAIRED OR REPLACED PARTS / COMPONENTS Where the Contractor is required to repair, replace or substitute Product or parts or components of the Product under the Contract, the repaired, replaced or substituted Products shall be subject to all terms and conditions for new parts and components set forth in the Contract including Warranties, as set forth in the Additional Warranties Clause herein. Replaced or repaired Product or parts and components of such Product shall be new and shall, if available, be replaced by the original manufacturer’s component or part.   • Preference for Domestically Manufactured Goods The provisions of paragraphs 2.54 and 2.55 of the Guidelines and Appendix 2 thereto shall apply to goods manufactured in the territory of the Borrower.

  • Tandem Switched Transport 7.3.4.2.1 For traffic delivered through a CenturyLink or CLEC tandem Switch (as defined in the Agreement), the Parties agree that, because this State is a new market for CLEC, tandem switched transport functions for Exchange Service (EAS/Local) non-transit traffic shall be compensated based upon the xxxx and keep compensation mechanism. Xxxx and keep will apply to both the tandem switching rate and the tandem transmission rate.
