Used Goods. Should the Agreement include the purchase of used machinery, parts, or equipment, said used machinery, parts, and equipment are sold “AS IS” AND “WITH ALL FAULTS”. HAWTHORNE MAKES NO WARRANTY RELATED TO THE TITLE OF THE GOODS FOR SALE UNDER THIS AGREEMENT, NOR TO THE RIGHTFUL TRANSFER OF THE GOODS, NOR TO THE EXISTENCE OF SECURITY INTEREST, LIENS, OR OTHER ENCUMBRANCES AGAINST THE GOODS. HOWEVER, HAWTHORNE WARRANTS THAT, AT THE TIME OF SALE, HAWTHORNE DID NOT KNOW OF ANY HOSTILE CLAIM OF TITLE OR ANY ENCUMBRANCES AGAINST THE GOODS FOR SALE UNDER THIS AGREEMENT.
Used Goods. If Customer is purchasing used Goods from WSECO, Customer acknowledges that the only warranties with respect to such used Goods are those warranties, if any, expressly set forth in the Service Agreement.
Used Goods. On entry into force of this Agreement, Chile shall cease applying the 50 percent surcharge established in the Xxxxx General Complementaria N° 3 of Arancel Aduanero with respect to originating goods of the other Party that benefit from preferential tariff treatment.
Used Goods. Distributor shall not sell any Articles that are used without the express prior written consent of Manufacturer. All used Articles approved for sales by Manufacturer shall be clearly marked "Used" and shall bear such other markings as may be required by the rules and regulations then in force in the Territory. All used Articles not approved and/or not sold in accordance with Manufacturer's approval shall be destroyed. Government Approvals. Distributor shall take all steps required by any local, provincial, national, or regional agency, government or commission to obtain the necessary licenses, permits, approvals, franchises or authority to carry out its obligations hereunder in compliance with applicable law. Distributor shall immediately provide copies of any communication to or from any such agency, government or commission that relates to or affects this Agreement or the Trademarks. Without limiting the generality of the foregoing, upon the execution of this Agreement, Distributor shall promptly, at Distributor's expense, file, or at the discretion of Manufacturer, assist Manufacturer in filing, with any and all governmental authority, or any department or agency thereof in the Territory, whose approval of this Agreement or whose registration of Distributor is deemed necessary or desirable by counsel to Manufacturer, copies of this Agreement and any and all applications, forms, documents, and exhibits deemed necessary or desirable by such counsel to secure such approvals, and Distributor shall take any and all further actions deemed necessary or appropriate by such counsel to secure such approvals.
Used Goods. Used Goods are sold in an “as is” condition. No warranty of any kind is supplied or given by BMG Parts in relation to used Goods.
Used Goods. USED GOODS ARE SOLD IN AN AS IS, WHERE IS CONDITION. SELLER MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE NATURE, QUALITY OR CONDITION OF THE GOODS, OR ITS SUITABILITY FOR ANY USE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, UNLESS EXPRESSLY AGREED UPON IN WRITING BETWEEN THE PARTIES. SELLER WILL HAVE NO LIABILITY TO BUYER HEREUNDER OR IN CONNECTION WITH THE GOODS, INCLUDING WITHOUT LIMITATION, FOR LOSS OF PROFIT, LOSS OF INCOME, LOSS OF PRODUCTION, LOSS OF OPPORTUNITY, INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR EXEMPLARY DAMAGES.
Used Goods. If Client is purchasing used Goods from COMPANY, Client acknowledges that the Used Goods are sold AS IS, and the only warranties with respect to such used Goods are those warranties, if any, expressly set forth in the xxxx of sale or other document signed by COMPANY.
Used Goods. If you have not sold used Goods within N/A days of the date we made an advance for the purchase of those Goods, you agree to make an immediate principal payment of 0.00 percent of the amount of the advance, due and payable by the 15th day of the month immediately following the month end. You agree to make additional principal payments of 0.00 percent of the amount of the advance every N/A days thereafter until the Goods are sold. If the Goods have not been sold within N/A days of the date we made an advance for the purchase of those Goods, you agree to pay us immediately in full the balance that you owe on that advance.
Used Goods. 8.1 Where the Customer offers used Goods as a trade in on any purchase of Goods from Customvac the Customer warrants that it is the owner of, and have the right to sell, the used Goods, and that it has clear title to the used Goods, and that the used Goods are free from any lien or other encumbrance.
Used Goods. 7.1 Where the Goods supplied under the Agreement are still subject to the manufacturer’s or (as appropriate) concessionaire’s warranty, they will be sold with the benefit of such warranty. Where you are purchasing as a consumer such warranty is additional to your statutory rights and is not affected by any change of ownership of the Goods. Remedial work under warranty may be carried out by any dealer or service workshop in the European Economic Area authorised directly or indirectly by the manufacturer, who may repair or replace any defective parts or (if he considers repair or replacement uneconomic) refund an appropriate part of the purchase price. Where such is available to us, we will provide you with a copy of the manufacturer’s warranty terms on delivery.
