Common use of Equipment and Inventory Clause in Contracts

Equipment and Inventory. With respect to any Equipment and/or Inventory of a Grantor, each such Grantor has exclusive possession and control of such Equipment and Inventory of such Grantor except for (i) Equipment leased by such Grantor as a lessee, (ii) Equipment or Inventory in transit with common carriers or (iii) Equipment out for repair or in the possession of employees in the ordinary course of business. No Inventory of a Grantor is held by a Person other than a Grantor pursuant to consignment, sale or return, sale on approval or similar arrangement.

Equipment and Inventory. With respect to any Equipment and/or Inventory of a Grantor, each such Grantor has exclusive possession and control of such Equipment and Inventory of such Grantor except for (i) Equipment leased by such Grantor as a lessee, (ii) Equipment or Inventory in transit with common carriers or out for repair, (iii) Equipment out for repair or in the possession of employees contract manufacturers and other service providers or (iv) computer equipment in the ordinary course possession of businessemployees. No Inventory of a Grantor is held by a Person other than a Grantor pursuant to consignment, sale or return, sale on approval or similar arrangement.

With respect to any Equipment material equipment and/or Inventory material inventory of a such Grantor, each such Grantor has exclusive possession and control of such Equipment equipment and Inventory inventory of such Grantor except for (i) Equipment equipment leased by such Grantor as a lesseelessor permitted by Section 7.1(b) of the Credit Agreement, (ii) Equipment equipment or Inventory inventory in transit with common or other carriers or (iii) Equipment out for repair or in as otherwise permitted by the possession of employees in the ordinary course of businessCredit Agreement.
