Common use of Employment by the Company Clause in Contracts

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Financial Officer of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Financial Executive Officer of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its 's Board of Directors (the “Board”"Board of Directors").

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and fullpart-time services in the capacity of the Executive Vice President and Chief Financial Officer Chairman (the “Executive Chairman”) of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity capacities of Executive Vice President and Chief Financial Executive Officer of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”). In addition, while Executive serves as President and Chief Executive Officer, he shall be nominated and recommended to shareholders to serve as a member of the Board.

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Senior Vice President and Chief Financial Officer of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) 's President and its Board of Directors (the “Board”"Board of Directors").

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Chief Executive Vice Officer (“CEO”) and President and Chief Financial Officer of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Senior Vice President and Chief Financial Officer of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defineddefined in Section 2), to render exclusive and full-time services in to the capacity of Company as its Executive Vice President and to perform such duties commensurate with such office as the Board of Directors of the Company (the "Board of Directors") and/or the Co-Chief Financial Officer Executive Officers of the Company shall reasonably direct. The Executive shall report directly to the Co-Chief Executive Officers of the Company, subject . The Executive shall devote his full business time to the control and direction business of the Company’s Chief Executive Officer (Company during the “CEO”) and its Board of Directors (the “Board”)term.

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defineddefined in Section 2 below), to render exclusive and full-time services in the capacity of Chief Executive Vice President and Chief Financial Officer ("CEO") of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its 's Board of Directors (the “"Board”").

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defineddefined in Section 2), to render exclusive and full-time services in to the capacity of Company as its Executive Vice President and Chief Financial Operating Officer to perform such duties commensurate with such office as the Board of Directors of the Company (the "Board of Directors") and/or the Co-Chief Executive Officers of the Company shall reasonably direct. The Executive shall report directly to the Co-Chief Executive Officers of the Company, subject . The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Financial Human Resources Officer of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Divisional Vice President and Chief Financial Officer — Tire Stores of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) President and its Board of Directors (the “Board”)Directors.

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Financial Operating Officer of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Financial Officer - Store Operations of the Company, subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), and the Executive hereby agrees to render exclusive and fullpart-time services in the capacity of the Executive Vice President and Chief Financial Officer Chairman of the CompanyCompany (the “Executive Chairman”), subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defineddefined in Section 2), to render exclusive and full-time services in to the capacity of Executive Vice Company as its President and Chief Financial Officer of the Company, subject to the control and direction of the Company’s Co-Chief Executive Officer (and to perform such duties commensurate with such office as the “CEO”) and its Board of Directors of the Company (the “Board”)"Board of Directors") shall reasonably direct.

Employment by the Company. (a) The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity position of Executive Vice President President, General Counsel and Chief Financial Officer of Secretary, and the Company, subject Executive accepts such employment and agrees to the control and direction of perform such duties as the Company’s Chief Executive Officer or his or her designee may assign from time to time. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Financial Officer of the CompanyCompany during the Executive Period (as herein defined), subject to the control and direction of the Company’s Chief Executive Officer (the “CEO”) and its Board of Directors (the “Board”), and to render services on a part-time basis as requested by the Company in the capacity of Director (Staff) during the Transition Period (as herein defined).
