Musicians engaged under this Agreement will permit Orchestra of the Swan to record sections of rehearsal and performance in sound and vision or in sound only for no additional fee in order to produce an EPK. The Musician will be informed by Orchestra of the Swan at the earliest opportunity of the intention to produce an EPK recording. Each EPK will have a maximum duration in aggregate of 20 minutes of orchestral material in any format to be used for promotional or marketing purposes only. Audio/visual recordings used in the EPK may include a musical piece in its entirety only where the recording is watermarked and is of a maximum duration of 20 minutes. Watermarked recordings in excess of 20 minutes duration will attract media points in accordance with clause 1 of Appendix 1. Where possible, all EPK recordings will be watermarked throughout their duration to deter unauthorised use. Sound recordings and audio/visual recordings that are not watermarked must not include any musical piece in its entirety, however short. EPK recordings may be used by Orchestra of the Swan for its own publicity material including its own website, artist profiles, arts and culture themed programming where the orchestra is featured and may include free and non-commercial presentation by Orchestra of the Swan to promote ticket sales for the concert(s) for which the Musician has been engaged under this Agreement. EPK recordings may also be used by third parties such as tourist boards and government agencies to promote the venue or city in which OOTS performs. EPK recordings shall not be used for the evaluation of the performance of any musician.

The Trust may record sections of rehearsal and performance scheduled within the Musician’s contracted hours to make audio and/or visual recordings for no additional fee in order to produce an EPK. The recorded excerpts used in the EPK must not include any musical piece in its entirety, however short, and will have a maximum duration in aggregate of 10 minutes of orchestral material in any format to be used for promotional or marketing purposes only. Audio/visual recordings of such excerpts will, where possible, be watermarked throughout their duration to deter unauthorised uses. EPK recordings may be used by the Trust for its own publicity material including the Trust’s own website, artist profiles, arts and culture themed programming where the orchestra is featured and may include free and non-commercial presentation by the Trust to promote ticket sales for performances by the orchestra. EPK recordings may also be initiated and used by agreement with visiting artists or their representatives for promotional or marketing use only on the artist/agents’ websites or similar. EPK recordings shall not be used for the evaluation of the performance of any musician.

This may include free and non-commercial presentation by the Serse Trust to potential donors, broadcasting in news, listings and topical magazine programmes specifically to promote ticket sales or sent to theatres and festival promoters to generate further performances of the production. Written permission must be sought from both the Trust and the Union by any participating singer wishing to use the EPK on a self-promotion website and the streaming of a complete aria shall not be permitted as this may pose a threat to future commercial release.

Paid Advertising Statement -------------------------- A statement of the paid advertising requirements for the Film, including a top sheet which indicates the exact placement, wording and size of each paid advertising credit. The statement shall also set forth obligations to accord credit in paperbooks, on sound recordings and in videocassette packages The statement shall contain photographic excerpts taken from the actual contracts of: a) credit obligations, and (b) name and/or likeness restrictions in connection with the advertising and/or publicity of the Film, merchandising and promotional tie- ins. 3. Cast and Crew List ------------------ (i) A list indicating: (a) the name of the character portrayed by each player, and (b) the names of all technical personnel (including their title or assignment) involved in the production of the Film. Including relevant addresses & telephone numbers of agents/representatives. V. E & O INSURANCE --------------- A copy of a "Motion Picture producer and Distributor Errors and Omissions" insurance policy as specified in Clause -- of the Agreement. VI.

Confirmation of a recording taking place will be provided in advance by the Press Office or by inclusion on the schedule.
