Common use of Duties and Services Clause in Contracts

Duties and Services. Executive agrees to serve in the position(s) referred to in Section 2.2 and to perform diligently the duties and services appertaining to such offices, as well as such additional duties and services appropriate to such offices which the parties mutually may agree upon from time to time. Executive’s employment shall also be subject to the policies maintained and established by the Company and the Parent that are of general applicability to the Company’s and the Parent’s employees, as such policies may be amended from time to time.

The Company agrees that the Executive may remain in his current position as President and CEO of the privately held Peak Operator LLC, and such involvement shall not in itself be considered a breach of this Agreement or a for Cause basis for termination of Executive’s employment shall also be subject to the policies maintained and established by the Company and the Parent that are of general applicability to the Company’s and the Parent’s employees, as such policies may be amended from time to timeemployment.
