Common use of Depositary Receipts Clause in Contracts

Depositary Receipts. Upon receipt of Proper Instructions, the Custodian shall surrender securities to the depositary used for such securities by an issuer of American Depositary Receipts or International Depositary Receipts (hereinafter referred to, collectively, as "ADRs"), against a written receipt therefor adequately describing such securities and written evidence satisfactory to the Custodian that the depositary has acknowledged receipt of instructions to issue ADRs with respect to such securities in the name of the Custodian or a nominee of the Custodian, for delivery to the Custodian at such place as the Custodian may from time to time designate. Upon receipt of Proper Instructions, the Custodian shall surrender ADRs to the issuer thereof, against a written receipt therefor adequately describing the ADRs surrendered and written evidence satisfactory to the Custodian that the issuer of the ADRs has acknowledged receipt of instructions to cause its depositary to deliver the securities underlying such ADRs to the Custodian.

Depositary Receipts. Upon receipt of Proper Instructionsproper instructions, to instruct a subcustodian appointed pursuant to Section 3 hereof (a "Subcustodian") or an agent of the Custodian shall appointed pursuant to Section 6E hereof (an "Agent") to surrender securities to the depositary used for such securities by an issuer of American Depositary Receipts or International Depositary Receipts (hereinafter collectively referred to, collectively, to as "ADRs"), ) for such securities against a written receipt therefor adequately describing such securities and written evidence satisfactory to the Custodian Subcustodian or Agent that the depositary has acknowledged receipt of instructions to issue ADRs with respect to such securities ADRs in the name of the Custodian Custodian, or a nominee of the Custodian, for delivery to the Custodian in Boston, Massachusetts, or at such other place as the Custodian may from time to time designate. Upon receipt of Proper Instructions, the Custodian shall instruct a Subcustodian appointed pursuant to Article V hereof to surrender securities to the depositary used that holds securities of an issuer that are represented by DRs for such securities by an issuer of American Depositary Receipts or International Depositary Receipts (hereinafter referred to, collectively, as "ADRs"), against a written receipt therefor adequately describing such securities and written evidence satisfactory to the Custodian Subcustodian that the depositary has acknowledged receipt of instructions to issue ADRs DRs with respect to such securities in the name of the Custodian Custodian, or a nominee of the Custodian, for delivery to the Custodian at such place as the Custodian may from time to time designate. Upon receipt of Proper Instructions, the Custodian shall surrender ADRs DRs to the issuer thereof, thereof against a written receipt therefor therefore adequately describing the ADRs DRs surrendered and written evidence satisfactory to the Custodian that the issuer of the ADRs DRs has acknowledged receipt of instructions to cause its depositary to deliver the securities underlying such ADRs DRs to the Custodiana Subcustodian. Section 3.06.

Upon receipt of Proper Instructions, the Custodian shall surrender ADRs DRs to the issuer thereof, thereof against a written receipt therefor adequately describing the ADRs DRs surrendered and written evidence satisfactory to the Custodian that the issuer of the ADRs DRs has acknowledged receipt of instructions to cause its depositary to deliver the securities underlying such ADRs DRs to the Custodiana Subcustodian.
