Common use of Defects Liability Period Clause in Contracts

Defects Liability Period. 15.1. 1The Contractor shall be responsible for all the Defects and deficiencies, except usual wear and tear in the Railway Project or any part thereof, till the expiry of a period of 2 (two) years commencing from the date of Provisional Certificate or expiry of a period 18 (eighteen) months from the date of Completion Certificate, whichever is later (the “Defects Liability Period”).

Defects Liability Period. 15.1. 1The 17.1.1 The Contractor shall be responsible for all the Defects and deficiencies, except usual wear and tear in the Railway Project Works or any part Section thereof, till the expiry of a period of 2 Five (two05) Years for Civil Works & Three years (03) for Mechanical, Electrical & Electronics Works commencing from the date of Provisional Certificate or expiry of a period 18 (eighteen) months the "Defects Liability Period"). Provided further that in the event no Provisional Certificate is issued, the Defects Liability Period shall commence from the date of the Completion Certificate, whichever is later (the “Defects Liability Period”).

For the avoidance of doubt, any repairs or restoration on account of usual wear or tear in the Project Works or any Section thereof shall form a part of the Maintenance obligations of the Contractor as specified in Article 14.
