Death in Immediate Family. A regularly scheduled employee may be granted up to five days of leave of absence with pay by the Agency/Department Head because of death in the immediate family. An employee shall be allowed to take such leave within a four week period. For purposes of this subsection, "immediate family" means mother, stepmother, father, stepfather, husband, wife, domestic partner (upon submission of an affidavit as defined in the appendices), son, stepson, daughter, stepdaughter, brother, sister, grandparent, grandchild, xxxxxx parent, xxxxxx child, mother-in-law, and father-in-law, or any other person sharing the relationship of in loco parentis; and, when living in the household of the employee, a brother-in-law, sister-in-law. Entitlement to leave of absence under this subsection shall be only for all hours the employee would have been scheduled to work for those days granted, and shall be in addition to any other entitlement for sick leave, emergency leave, or any other leave.

Death in Immediate Family. For a death in the immediate family, up to five days' absence, as determined by the Superintendent, will be granted. "Immediate family" will include mother, father, brother, sister, son, daughter, wife, husband, mother-in-law, father-in-law, grandparents, and any other relative living with the teacher as a permanent member of the family. Cases of an unusual nature, not covered by this regulation, will be resolved by the Superintendent.

Except for employees in the classification of Juvenile Institutional Officer Intermittent, an additional two days leave may be granted by the Agency/Department Head and charged to the employee's accrued sick leave balance in the event that one-way travel in excess of 300 road miles from the employee's residence is required. Entitlement to leave of absence under this Section shall be only for all hours the employee would have been scheduled to work for those days granted, and, insofar as the first three days are concerned, shall be in addition to any other entitlement for sick leave, emergency leave, or any other leave. For purposes of this Section, "immediately family" means mother, step-mother, father, step- father, husband, wife, domestic partner (as defined in Appendix B), son, step-son, daughter, step-daughter, brother, sister, mother-in-law, father-in-law, xxxxxx parent, xxxxxx child, grandparent, grandchild or any other person sharing the relationship of in loco parentis; and, when living in the household of the employee, a brother-in-law, and sister-in- law. In the case of the death of the employee’s mother-in-law, father-in-law, grandparents, or grandchildren, where the decedent was not living in the employee’s household, the employee shall be entitled to one day of leave of absence with pay. Immediate family shall be understood to mean: spouse (including established civil union), children, brother, sister, father, mother, step-parents, step-children, mother-in-law, father-in-law, son-in-law, daughter-in-law, xxxxxx parents, and xxxxxx children. Employees shall be allowed one (1) day off without loss of pay in case of the death of grandmother, grandfather, grandchild, sister-in-law and brother-in-law. Time off with pay under this section shall be limited solely to instances involving the death of family members specifically mentioned herein, and all prior interpretive decisions permitting pay under special circumstances shall be nullified.

Immediate family includes: Husband, wife, children, father, mother, father-in-law, mother-in-law, grandfather, grandmother, brothers, sisters, and any other relative or non-relative living or making his/her home in the household of the employee or for whose funeral arrangements the employee is responsible.

Death in Immediate Family. For no more than a total of five (5) school days per incident for death in the Director of Special Education immediate family, as defined previously in this Article and which for purposes of Section C shall also include grandchildren. In the event of the death of a brother-in-law or sister-in- law, a member shall be eligible to use two (2) of the five (5) days provided by the section.
