Connection Fee. 20.1.1. For the purposes of Section 19 and this Section 20, the following definitions shall apply: "Connection Facilities" "Connection Costs" "Connection Fee Budget" "Connection Fee Budget Tolerance" - shall mean the PRMS and any additional investment made by INGL in the Shipper's premises; - shall mean the actual investment costs associated with the Connection Facilities, including the cost of land, design, supervision, third party inspection, materials, construction and equipment, and a management charge of 2% of the Connection Fee Budget for all items except the cost of land, supervision and third party inspection ("Management Charge"); - Shall mean the budget for the Connection Costs set out in Annex 2 (Connection Fee Budget) to Appendix 1 (Commercial Terms); - Shall mean 10% of the Connection Fee Budget excluding the cost of land and the Management Charge, plus the difference between the actual cost of land and that provided for in the Connection Fee Budget;

Connection Fee. The District shall collect, from each new District User within the Service Area, a one-time connection fee of four hundred dollars ($400.00) (the "Connection Fee"). Prior to the District allowing any party to tap into the District's sanitary sewer collection system, the District: (1) shall receive notification from the City that the City Tap Fee and SSDF have been paid in full; (2) shall receive notification from the City that the waiver and release of liability form, in the form attached as Exhibit B hereto, has been executed; and (3) shall verify that the Connection Fee has been received by the District. The City shall notify the District that (1) and (2), above, have been completed by completing and delivering written notification to the District (or by email, with email delivery preferred) is substantially the form attached hereto as Exhibit C. The City shall deposit all City Tap Fees and SSDFs received from District Users into a separate interest bearing account (the "Capital Expansion Fund"), and shall notify the District in writing on or before November 30th of each year of the current balance in the Capital Expansion Fund. The Parties agree that the current balance of the Capital Expansion Fund, as of September 30, 2008, is Thirty One Thousand Two Hundred Three Dollars and 75/100 ($31,203.75). All interest earnings on the funds deposited in the Capital Expansion Fund shall be retained therein and shall be used solely for the purposes and pursuant to the provisions of this Agreement.
