Category B. (a) The regular work day shall be eight (8) hours and the regular work week five (5) consecutive days unless the work schedule is modified to provide for a flexible workday or work week, to a maximum of ten (10) hours per day exclusive of meal periods*, on the understanding that the biweekly hours of work set out in Article 62:01 are maintained. All hours worked beyond the scheduled daily or biweekly hours are subject to the overtime provisions set out in Article 63.
Category B. If the employee holding the eliminated position is employed in Category B job classification, that employee shall have the right to replace the least senior employee in Categories B, C and D provided the employee has more seniority than that employee being replaced and is qualified to perform the duties and responsibilities of the position.
Category B. The post(s) are considered to have significant elements of the tasks, duties and responsibilities to a post(s) in the previous structure, though the grade and the reporting relationship may be different. There may be one or more Chief Officers who can be identified as being available for assimilation to this post(s). Such Chief Officers will be identified through the comparison of their existing substantive post with the criteria specified at paragraphs 2.9 and 2.10 of this Agreement. Where only one Chief Officer is identified as being available on the basis of his/her key tasks, duties and responsibilities of a former/existing post, then this Chief Officer should undergo a selection process to assess their suitability for the post. Where more than one Chief Officer can be identified as performing part of the constituent tasks/duties and responsibilities, then “limited competition selection” should take place (as between the identified candidates for the role). If none of the Chief Officers satisfy the requirements of the selection process then no appointment should be made. Where no Chief Officer is appointed, this post becomes open for recruitment as with any other vacant post.
Category B. All regular full and part-time non-supervisory, managerial, and professional employees:
Category B. The normal work day shall be eight (8) consecutive hours and the normal work week five (5) consecutive days with two (2) consecutive days off or any other shift schedule mutually agreeable to the parties. Scheduled shifts will span 8:00 a.m. to midnight Monday to Sunday. Category B employees shall have a forty-five (45) minute meal break but shall remain in the general work area and be available for duty should the need arise.
Category B. Employees coming within Category (B) of Section :01 shall work a regular work day of eight (8) consecutive hours exclusive of meal periods and a regular work week of forty (40) hours. Such meal periods shall not exceed thirty (30) minutes in duration, however, where it is mutually agreed between the supervisor and the employee, such meal periods shall not exceed one (1) hour in duration.

Category B. Category B includes sanitary sewer users who discharge wastewater with concentrations in excess of 200 mg/l of BOD, 250 mg/l of suspended solids, 10 mg/l of phosphorus, or chlorides greater than 450 mg/l. Users whose wastewater exceeds the concentrations for any one of these parameters shall be in category B. The sewer service charge for category B wastewater, as well as the amount of surcharges to be imposed by the Utility to cover the cost of treating exceedances, shall be shall be determined by resolution of the Town Board, from time to time.
