Care and Use. Lessee shall use and operate the Aircraft in a careful and proper manner. Lessee shall operate the Aircraft in accordance with the flight manual and all manufacturer’s suggested operating procedures. Lessee shall not operate, use, or maintain the Aircraft in violation of any airworthiness certificate, license, or registration relating to the Aircraft, or contrary to any law or regulation.
Care and Use. The equipment must not be used by anyone else except the student during the rental period. During the rental period, the student must care for the equipment and ensure that it is kept in a responsible manner. All instructions which accompany the equipment as well as the school's rules regarding ICT usage must be followed. It is the student's responsibility to be especially careful and protective of the equipment in use and storage since it is property prone to theft. The equipment must therefore be kept under supervision or must be locked away. The equipment must always be brought home at the end of the school day. The equipment must be brought to school fully charged at the start of every school day. The equipment must always be transported in its accompanying case outside. The computer cover must always be shut when the computer is transported. The student is responsible for ensuring that the equipment is not used in an unlawful way such as downloading copyright protected material. Material which can be considered offensive or insulting may not be stored on the equipment. The student may not use the equipment to visit websites containing such material. The student may not use the equipment to insult or bully another person. In cases where software is installed on the equipment, it is the student's responsibility to ensure that valid licences exist. File-sharing programmes may not be installed on the equipment.
Care and Use. The City shall use the Equipment in a careful and proper manner for its governmental purposes, in compliance with all applicable laws and regulations, and, at its sole cost and expense, shall service, repair and maintain the Equipment so as to keep the Equipment in good condition, repair, appearance and working order for the purposes intended, ordinary wear and tear excepted, and shall replace any part of the Equipment as may from time to time become damaged or destroyed, lost or stolen. In addition, the City agrees to comply in all respects with all applicable laws, regulations and rulings of any legislative, executive, administrative, or judicial body, including, without limitation, all anti-money laundering laws and regulations; provided that the City may contest in good faith the validity or application of any such law, regulation or ruling in any reasonable manner that does not, in the opinion of Lender, adversely affect the interest of Lender in and to the Equipment or its interest or rights under this Contract. However, the City is not obligated to renew, repair or replace any inadequate, obsolete, unsuitable, undesirable or unnecessary Equipment. Notwithstanding any provision herein to the contrary, any and all additions to or replacements of the Equipment and all parts thereof constitute accessions to the Equipment and are subject to all the terms and conditions of this Contract and are included in the term “Equipment” as used in this Contract.

Any and all additions to or replacements of the Equipment and all parts thereof shall constitute accessions to the Equipment and shall be subject to all the terms and conditions of this Agreement and included in the term "Equipment" as used in this Agreement.
Care and Use. Customer shall use Equipment in accordance with the applicable product description and operator’s and/or user's manual. Customer shall supervise, manage and control the proper use of Equipment (including routine Customer maintenance that Fujitsu reasonably specifies) according to the terms of this Agreement. Customer shall ensure that properly trained staff use Equipment and follow related advice and recommendations from Fujitsu. Customer is responsible for all backup, disaster recovery, restart procedures, checks for accuracy, and security of data.
Care and Use. Lessee, at Lessee’s sole cost and expense, shall maintain and keep the Equipment in good repair, condition, and working order, shall provide the proper physical environment for the Equipment, shall not use the Equipment unlawfully, and shall not alter the Equipment without Lessor’s prior written consent.
Care and Use. The Customer shall use the Equipment and Programs in the manner contemplated by CoCre8's Product Description relating thereto. The Customer shall supervise, manage and control the proper use of the Equipment and Programs (including routine Customer maintenance, if any) in the manner that CoCre8 may reasonably specify from time to time. The Customer shall also ensure that adequate backup plans, restart procedures, checks for accuracy and security of data together with other necessary procedures and controls are provided by the Customer to meet its requirements.

The County shall use, and shall cause the use of, the Project in a careful and proper manner, in compliance with all applicable laws and regulations, and, at its sole cost and expense, shall service, repair and maintain the Project so as to keep the Project in good condition, repair, appearance and working order for the purposes intended, ordinary wear and tear excepted, and shall replace any part of the Project as may from time to time become worn out, unfit for use, lost, stolen, destroyed or damaged. Any and all additions to or replacements of the Project and all parts thereof shall constitute accessions to the Project and shall be subject to all the terms and conditions of this Contract and included in the term “Project” as used in this Contract.
Care and Use. During the Construction Phase, it shall be Linn’s responsibility to maintain all perimeter fencing and during non-construction hours security devices and security personnel as shall be necessary to restrict access to the Job Site and to prohibit non-authorized persons from having access to all or any portion of the Job Site. As agreed by the parties, it shall be BCCK’s responsibility for security personnel and to prohibit non-authorized persons from having access to all or any portion of the Job Site during construction hours. During the Construction Phase, BCCK shall be responsible for noise abatement, Project health and safety, and containment procedures as shall be necessary to prevent a nuisance, damage or injury to adjacent property owners, BCCK’s or Linn’s agents, employees, invitees or Subcontractors or any environmental hazard or pollution risk.
Care and Use. Employee agrees to maintain the LTU Laptop in good operating condition, repair and appearance, and protect the same from deterioration, other than normal wear and tear. The Employee agrees to use LTU Laptop in educational course work, within its normal capacity, without abuse, and in a manner contemplated by the University. Employee agrees not to use the IP address assigned to its LTU Laptop on any other computer, and agrees not to attempt to disguise or conceal the identity of the account or LTU Laptop. Employee agrees to abide by the terms of all licensing agreements and copyright laws. Employee agrees not to make copies of copyrighted software, unless the Xxxxxx Xxxxxx Computing Center has a site license specifically allowing the copying of that software. In addition, Employee agrees not to copy site-licensed software for distribution to any person or for use on any other computer. Employee agrees to comply with the laws, ordinances, regulations, and other requirements that may be applicable with respect to the use, maintenance, and operation of the LTU Laptop. Further, Employee agrees to comply with all rules, regulations, and procedures governing the proper use of University computers and its network as set forth by the Xxxx of Students, Microsoft Campus Subscription Agreement, and Acceptable Use Policy. All three of these documents are available for review in the LTU’s library. Alterations and/or Additions: Employee agrees not to make any physical alterations and/or additions to LTU Laptop other than normal operating accessories or controls that are acceptable to the University. Employee may obtain alterations and additions to the LTU Laptop at his/her option with concurrence of University. Such alterations and/or additions shall remain the property of the Employee. It is the employee’s responsibility to remove all personal information from the laptop prior to return. Maintenance: Employee agrees to keep the LTU Laptop in good operating condition and will make the LTU Laptop available to the university to make necessary adjustments and repairs. Employee agrees not to permit persons other than authorized representatives of University to effect adjustments or repairs. University shall in no way be responsible to Employee for loss of the use of the LTU Laptop occasioned by adjustments and repairs made by persons other than its own representatives or personnel approved by the University.
