Annual Engineering Report. By September 1 of each Fiscal Year, a reserve engineering report prepared by the Independent Engineers as of July 1 of such Fiscal Year concerning all of the Oil and Gas Properties and interests owned by any Restricted Person that are located in or offshore of the United States and that have attributable to them Proved Reserves. This report shall (i) be prepared on a consistent basis in accordance with customary standards and procedures of the petroleum industry, (ii) take into account any overproduced or underproduced status under gas balancing arrangements, (iii) reflect the respective interests of the Restricted Persons in such Oil and Gas Properties, and (iv) contain information and analysis comparable in scope to that contained in the Initial Engineering Report.

Annual Engineering Report. Seller and Buyer will each require an engineering report evaluating the gas reserve quantities attrib- utable to the Interests as of their fiscal years ending December 31 (the "Annual Reserve Report"), Seller for the purpose of reporting the gas reserves attributable to the Produc- tion Payment and the Reversionary Interest, if any, in its SEC filings, and Buyer for reporting cost depletion for income tax pur- poses. Seller will cause XxXxxxx, Xxxxxxxx & Associates, or any other independent, quali- fied petroleum engineering firm acceptable to Buyer, to prepare the Annual Reserve Report and to furnish it to both parties as promptly as possible after the end of each calendar year. The expense of the Annual Reserve Report shall be borne by Seller and Buyer equally."
Annual Engineering Report. In connection with each of the Collateral Borrowing Base semi-annual valuation and redeterminations made as of each March 31 (commencing March 31, 2005), the Borrower shall have furnished to the Bank a comprehensive engineering report of the Mortgaged Property encumbered by the Mortgage, prepared by a bona fide and reputable outside engineering firm reasonably acceptable to the Bank, which such report shall be effective as of a date no earlier than January 1 of such applicable calendar year in which it is to be submitted to the Bank. Such report shall be furnished in full to the Bank no later than February 28 of such applicable calendar year, commencing with February 28, 2005.

  • Annual Independent Accountants’ Report The Servicer shall cause a firm of nationally recognized independent certified public accountants (the "Independent Accountants"), who may also render other services to the Servicer or to the Seller, to deliver to the Trustee, the Owner Trustee, the Trust Collateral Agent, the Backup Servicer, the Insurer and each Rating Agency, on or before October 31 (or 120 days after the end of the Servicer's fiscal year, if other than June 30) of each year, beginning on October 31, 1999, with respect to the twelve months ended the immediately preceding June 30 (or other applicable date) (or such other period as shall have elapsed from the Closing Date to the date of such certificate), a statement (the "Accountants' Report") addressed to the Board of Directors of the Servicer, to the Trustee, the Owner Trustee, the Trust Collateral Agent, the Backup Servicer and to the Insurer, to the effect that such firm has audited the books and records of AmeriCredit Corp., in which the Servicer is included as a consolidated subsidiary, and issued its report thereon in connection with the audit report on the consolidated financial statements of AmeriCredit Corp. and that (1) such audit was made in accordance with generally accepted auditing standards, and accordingly included such tests of the accounting records and such other auditing procedures as such firm considered necessary in the circumstances; (2) the firm is independent of the Seller and the Servicer within the meaning of the Code of Professional Ethics of the American Institute of Certified Public Accountants, and (3) includes a report on the application of agreed upon procedures to three randomly selected Servicer's Certificates including the delinquency, default and loss statistics required to be specified therein noting whether any exceptions or errors in the Servicer's Certificates were found.

  • Progress Report 10.1 If required, you shall submit progress reports in connection with the Service (“Report”) on at least a monthly basis, or as we may require. The Report shall include a summary of the activities and accomplishments during the previous reporting period.
