Access Period. If during its first Performance Test, Unit #3 does not meet the Performance Guarantees, Seller shall be afforded sufficient access to such Unit to allow Seller to undertake corrective action. Unit #4 will be re-tested when Seller so requests, provided Seller has given forty-eight (48) hours’ written notice to Purchaser to conduct each subsequent Performance Test.

Access Period. The Access Period is a duration of time under the term of this Agreement when Licensee is granted access to and Permissible Use of Data. The Access Period may be suspended as set forth elsewhere in this Agreement, however during such suspension, all other terms and conditions of this Agreement remain in effect.
