The terms and conditions of this XXXX will also apply to You and shall remain fully enforceable between Xxxxxxxxx Electric and You even if the Software Product will be delivered to You as a mobile application through any mobile applications platform or store proprietary to Xxxxxxxxx Electric or to any third party officially appointed or recognised by Xxxxxxxxx Electric to commercialize the Software Product as a mobile application. Additionally, the terms and conditions of this XXXX will apply to You even if You obtained the Software Product from an authorized Xxxxxxxxx Electric distributor or reseller. This XXXX only gives you limited rights to use the Software Product and Xxxxxxxxx Electric and its licensors reserve all other rights. You do not acquire any rights, express or implied, other than those expressly granted in this XXXX. You agree that You will use the Software Product only as expressly permitted in this XXXX and You will comply with any technical limitations in the Software Product that only allow You to use the Software Product in certain ways.

  • If a product becomes defective within the Xxxxxxxxx Electric contractual warranty period, one of the following options, as selected by Xxxxxxxxx Electric, will be performed at no charge for materials or labor costs, unless this should be impossible or disproportionate.

  • If the returned defective Product to Xxxxxxxxx Electric (or service partner) pursuant to this Policy, and is found by Xxxxxxxxx Electric to be free of defects that would qualify it for repair or replacement under this Policy, Xxxxxxxxx Electric may charge a flat-rate inspection charge for each product of $250 USD, plus shipping and packaging costs.
