Xxxxxxx Group means (i) any member of the Xxxxxxx Family, (ii) Xxxxxxx Energy Partners I, LP and SEP Management I, LLC, (iii) Xxxxxxx Parent, (iv) Xxxxxxx Investor, (v) Xxxxxxx Production Partners LP, (vi) Xxxxxxx Oil & Gas Corporation, (vii) Blackstone Newco and (viii) any Person Controlled by any one or more of the foregoing (other than the General Partner, the Partnership or any of their respective Subsidiaries).

Xxxxxxx Act means the Xxxxxxx Antitrust Act of 1890, as amended, and the rules and regulations promulgated thereunder.
Xxxxxx Group shall have the meaning set forth in Section 9.2(b) hereof.
Xxxxxxxx Loan means a Subsidized Xxxxxxxx Loan or an Unsubsidized Xxxxxxxx Loan.
Xxxxx Fargo means Xxxxx Fargo Bank, National Association, a national banking association.
Xxxxxxx Family means Xxxxx X. Xxxxxxx, Xxxxx X. Xxxxxxx, Xx., Xxxxxx Xxxxxxx, Xxxx Xxxxxxx and the members of their Families.
Xxxxxxxx-Xxxxx Act means the Xxxxxxxx-Xxxxx Act of 2002.
Sxxxxxxx-Xxxxx Act means the Sxxxxxxx-Xxxxx Act of 2002, as amended.
Xxxxxxx Xxxxxxx Policy means the written policy of the Company pertaining to the sale, transfer or other disposition of the Company’s equity securities by members of the Board, officers or other employees who may possess material, non-public information regarding the Company, as in effect at the time of a disposition of any Stock.
Xxxxxxx Rule means Section 13 of the U.S. Bank Holding Company Act of 1956, as amended, and the applicable rules and regulations thereunder.
Xxxxx–Xxxxx Act For any federally assisted construction contract, in excess of two thousand dollars ($2,000), the contractor, subcontractor, subrecipient shall comply with all of the requirements of the Xxxxx-Xxxxx Act (40 U.S.C. 3141 – 3148) as supplemented by Department of Labor Regulations (29 CFR Part 5, “Labor Standards Provisions Applicable to Contracts Covering Federally Financed and assisted Construction”); and the Xxxxxxxx “Anti-Kickback” Act (40 U.S.C. 3145), as supplemented by Department of Labor regulations (29 CFR Part 3, “Contractors and Subcontractors on Public Building or Public Work Financed in Whole or in Part by Loans or Grants from the United States”). Xxxxx Group means Xxxxx and any Affiliate of Xxxxx.

Xxxxxage The mortgage, deed of trust or other instrument securing a Mortgage Note, which creates a first lien, in the case of a First Lien Loan, or a second lien, in the case of a Second Lien Loan, on an unsubordinated estate in fee simple in real property securing the Mortgage Note; except that with respect to real property located in jurisdictions in which the use of leasehold estates for residential properties is a widely-accepted practice, the mortgage, deed of trust or other instrument securing the Mortgage Note may secure and create a first or second lien upon a leasehold estate of the Mortgagor.
Xxxx-Xxxxx Act means the Xxxx-Xxxxx Xxxx Street Reform and Consumer Protection Act.
Xxxxxx means Xxxxx’x Investors Service, Inc. and any successor thereto.
Xxxx-Xxxxx-Xxxxxx Act means the Xxxx-Xxxxx-Xxxxxx Antitrust Improvements Act of 1976, as amended.
Mxxxx’x means Mxxxx’x Investors Service, Inc.
Xxxxxxx means an employee elected or appointed by the Union who is authorized to represent the Union, an employee or both.
