Worker with a disability definition

Worker with a disability means an individual whose earnings or productive capacity is impaired by a physical or men- tal disability, including those relating to age or injury, for the work to be performed. Disabilities which may affect earning or produc- tive capacity include blindness, mental illness, mental retardation, cerebral palsy, alcoholism and drug addiction. The following, taken by themselves, are not considered disabilities for the pur- poses of this section: vocational, social, cultural, or educational disabilities; chronic unemployment; receipt of welfare benefits; nonattendance at school; juvenile delinquency; and correctional parole or probation. Further, a disability which may affect earning or productive capacity for one type of work may not have this effect for another type of work.
Worker with a disability means a worker whose earn- ing capacity is impaired by age or physical or mental deficiency or injury and who is being served in accordance with the recog- nized rehabilitation program of a sheltered workshop within the facilities of such agency or in or about the home of the worker.
Worker with a disability means a worker who is afflicted with, or subject to, any permanent physical or mental impairment, whether congenital or due to an injury or disease, including periodic impairment of consciousness or muscular control of such character that the impairment would prevent the worker from obtaining or retaining employment.

  • Child with a disability means a child who, by reason of any of the following, needs special education and related services:
