The HCP/NCCP and each of its provisions is intended to be, and by this reference are, incorporated herein. The provisions of the HCP/NCCP and this Agreement are intended to be consistent with and to complement each other and shall be interpreted accordingly. However, to the extent that this Agreement contradicts or conflicts with the HCP/NCCP, the terms of this Agreement shall control. The provisions of the Federal and State Permits and this Agreement are intended to be consistent with and to complement each other and shall be interpreted accordingly. To the extent that one of the Federal Permits or State Permit contradicts or conflicts with this Agreement, the terms of the Federal Permit or State Permit shall control with regard to that Permit only. Each Wildlife Agency has reviewed the Federal or State Permit that it issued and has concluded that it is consistent with this Agreement and does not contradict or conflict with any term or condition of this Agreement. Similarly, MRC has reviewed the Federal and State Permits and has concluded that they are consistent with this Agreement and do not contradict or conflict with any term or condition of this Agreement. FINDINGS AND OBLIGATIONS OF THE WILDLIFE AGENCIES USFWS USFWS Findings As further described in the findings issued by USFWS, USFWS has found that the HCP/NCCP satisfies the permit issuance criteria under Section 10(a)(2)(B) of the ESA for each Covered Species that is a Federal Listed Species within the jurisdiction of USFWS. For each Covered Species that is not a Federal Listed Species as of the Effective Date, USFWS has found that the HCP/NCCP satisfies the permit issuance criteria under section 10(a)(2)(B) of the ESA that would otherwise apply if such Covered Species were a Federal Listed Species.
Wildlife Agencies means those agencies that are charged with the regulation of wildlife within the county of Placer, and include but are not limited to the U.S. Fish and Wildlife Service (USFWS), the National Marine Fisheries Service (NMFS), and the California Department of Fish and Wildlife (CDFW).
