Waters of the United States definition

Waters of the United States or "waters of the U.S." means:
Waters of the United States means all waters as defined by 40 CFR 122.2 and as otherwise specified by applicable laws and regulations.
Waters of the United States means waters described by 33 CFR 328.3(a)(3).

Waters of the United States. ’ means the navigable waters and the territorial sea of the United States; and

Waters of the United States means surface watercourses and water bodies as defined within 40 CFR Section 122.2 including all natural waterways and definite channels and depressions in the earth that may carry water, even though such waterways may only carry water during rains and storms and may not carry stormwater at and during all times and seasons.
Waters of the United States means, as defined in section 502(7) of the Federal Water Pollution Control Act (hereinafter referred to as the “FWPCA”), and includes: “(1) all navigable waters of the United States, as defined in judicial decisions prior to the passage of the 1972 Amendments of the FWPCA (Pub. L. 92-500) also known as the Clean Water Act, and tributaries of such waters as; (2) interstate waters; (3) intrastate lakes, rivers, and streams which are utilized by interstate travelers for recreational or other purposes; and (4) intrastate lakes, rivers, and streams from which fish or shellfish are taken and sold in interstate commerce.”
Waters of the United States means surface water and water bodies as defined by EPA regulations (e.g., 40 CFR Section 122.2). All waters of the United States in California are also "waters of the state" (defined by the Porter-Cologne Water Quality Control Act as "any surface water or ground water, including saline waters, within the boundaries of the state." [Water Code Section 13050(e)]). Not all waters of the state (e.g., ground water) are waters of the United States.
Waters of the United States means water subject to the regulatory jurisdiction of the United States under the Federal Clean Water Act and applicable case law. In general, this includes “navigable” waters, waters tributary to “navigable” waters, and adjacent wetlands.
