WARRANTY AND DISCLAIMER. As set forth herein, different warranties may apply to different categories of Equipment. As to all Equipment, except as expressly set forth in this section and Section 13, SELLER MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AS TO MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR ANY OTHER MATTER WITH RESPECT TO ANY OF THE EQUIPMENT. The warranties made in this section are in lieu of any other warranty, express or implied and are expressly subject the terms of this Contract, including Section 14 hereof. The warranties made in this section and in Section 13 are the only warranties made by Seller and can be amended only by a written instrument signed by an officer of Seller having a title of vice president or higher.

WARRANTY AND DISCLAIMER. Mimio warrants for a period of two years from the date of receipt that (i) the Software will perform substantially in accordance with the accompanying documentation in material aspects and (ii) the storage media (if any) containing the Software will be free from any material defects in materials or workmanship. • ONE YEAR NON-TRANSFERRABLE LIMITED WARRANTY AND DISCLAIMER LEDGlow Lighting, LLC ("LEDGlow") warrants to the original retail consumer purchaser, and not any other purchaser or subsequent owner, that this Product will be free from defects in material or workmanship for a period of one (1) year from the purchase date.

• NOTWITHSTANDING SECTION 9 (LIMITED WARRANTY AND DISCLAIMER), DURING A FREE TRIAL, THE SOFTWARE AND ANY APPLICABLE SERVICES ARE PROVIDED “AS-IS” WITHOUT WARRANTY OF ANY KIND.

• BUYER ACKNOWLEDGES THAT MARLO’S PRICE IS LOWER THAN IT OTHERWISE WOULD BE BECAUSE OF MARLO’S LIMITED WARRANTY AND DISCLAIMER OF TORT LIABILITY, AND SPECIFICALLY BECAUSE OF MARLO’S DISCLAIMER OF THE TORTS OF NEGLIGENCE, MISREPRESENTATION, AND STRICT LIABILITY.
