The Subscriber must pay any taxes (including but not limited to any applicable Value Added Taxes, Sales Taxes, and Import Taxes) other than taxes on ASCE’s net income, arising out of the Subscriber’s use of the Licensed Materials and/or the rights granted under this Agreement.
Value Added Taxes means such sum as shall be levied upon the Contract Price by the Federal or any Provincial or Territorial Government and is computed as a percentage of the Contract Price and includes the Goods and Services Tax, the Harmonized Sales Tax, and any similar tax, the collection of which have been imposed on the Contractor by the tax legislation.
The Allowances include all taxes and duties (except only Value Added Taxes).
Guaranteed Price, which excludes Value Added Taxes, is equal to the sum of the Cost of the Work (which includes the Contractor’s Design Contingency and the Contractor’s Fee) and the Cost of the Financing.
The Overhead and Profit Fee is the amount stipulated in GC 6.2.4 which excludes the Value Added Taxes.
