Utilities definition

Utilities means water, sewer, gas, electric, telecom, cable, and like services.

Utilities means electricity, gas, water, foul water and surface drainage, heating, ventilation and air conditioning, smoke and fumes, signals, telecommunications, satellite and data communications and all other utilities;

• However, regardless of the arrangements made with the Utility Owners and except as otherwise provided in Article 13, Developer shall continue to be the responsible party to TxDOT for timely performance of all Utility Adjustment Work so that upon completion of the Work, all Utilities that might impact the Facility or be impacted by it (whether located within or outside the Facility Right of Way) are compatible with the Facility.

• It also authorizes Developer to enter the Facility Right of Way TxDOT owns, after coordinating with TxDOT’s Area Office, in order to conduct surveys and site investigations, including geotechnical, Hazardous Materials and Utilities investigations, and to engage in the other activities anticipated to be performed after NTP1 referenced in the Technical Provisions, including satisfying the conditions to issuance of NTP2 under Section 7.7.2.2.
