Examples of use of the Software in a sentence

  • This Agreement, Your invoice, and any terms located at a URL hyperlink referenced herein, including any updates made in accordance with Section 13.11 (Updated Terms), constitute the entire agreement between the Parties regarding Your use of the Software, and supersede any prior written or oral agreements between the Parties for the applicable Software.

  • The Parties acknowledge that the scope of the Professional Services provided thereunder may consist of (a) training to assist with Software installation, deployment, and usage, and (b) training in use of the Software.

  • If You do not provide Us with notice of termination in accordance with this Section 13.11, Your continued use of the Software constitutes Your acceptance of the updated terms of the Minitab Policies.

  • Upon Minitab’s written request, You shall certify in a signed writing that Your use of the Software is in full compliance with the terms of this Agreement.

  • If any infringement claim with respect to Your access to, or use of, the Software may be or has been asserted, We shall, at Our option and expense, (a) procure the right to continue accessing and using the Software or (b) replace or modify the Software to eliminate the infringement while providing functionally equivalent performance.

  • All other U.S. Government personnel using the Software are hereby on notice that use of the Software is subject to restrictions that are the same as, or similar to, those specified above.

  • If the Customer obtains a fee-based license that includes the use of the Software and Services by its and/or its Affiliates’ employees or representatives, then the Customer shall ensure that any user making use of the Customer’s license complies with the terms and conditions of use set forth in this XXXX.

  • You shall have a license right to use any deliverables (including any documentation, code, Software, training materials or other work product) delivered as part of the Professional Services (“Deliverables”) solely in connection with Your authorized access and use of the Software, subject to all the same terms and conditions as apply to Your authorized use and access to the Software, and subject to any additional terms and conditions provided with the Deliverables.

  • Any such user acknowledges and agrees that its use of the Software and/or Services is subject to the Customer’s license and that TeamViewer may, on behalf and upon instruction of the Customer, restrict or prevent the user from making use of the Customer’s license.


More Definitions of use of the Software

use of the Software means that the software is either loaded into the computer’s memory (RAM) or saved onto permanent storage (for example, hard disk, CD-ROM). The number of print servers, computers, groups and users administered by the software is defined as part of the acquired license. Should the specified limit ever be exceeded, the licensee must ensure that appropriate mechanisms or procedures are in place to again comply with the specifications set out in the license.
use of the Software means to access and use the Software in object code form that is installed on the Designated Hardware solely for the purposes expressly authorised by these Terms and Conditions and in accordance with these Terms and Conditions.

Related to use of the Software

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • The Software means the software designed and developed by the Consultant or the Consultant’s Personnel, and includes the source code and object code along with associated documentation, which is the work product of the development efforts envisaged in the Terms of Reference. It does not include commercial off-the-shelf licensed software (except for the customisation components of such products).

  • Supplier Software means software which is proprietary to the Supplier or its Affiliates which is used or supplied by the Supplier in the provision of the Services; Supplier Staff means all persons employed or engaged by the Supplier together with the Supplier's servants, agents, suppliers, consultants and Sub-Contractors (and all persons employed by any Sub-Contractor together with the Sub-Contractor’s servants, consultants, agents, suppliers and Sub-Contractors) used in the performance of its obligations under this Contract; Time and Materials means the pricing mechanism for the Services as may be agreed by the Parties and set out at paragraph Error: Reference source not found in the SOW; TUPE means the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) as amended or replaced or any other regulations or UK legislation implementing the Acquired Rights Directive; Velocity means the Metric which measures the total number of Story Points for Stories that have been accepted in a Sprint, indicating the rate of progress towards Acceptance of all Stories from the Product Backlog;

  • Third Party Software means software which is proprietary to any third party (other than an Affiliate of the Contractor) which is or will be used by the Contractor for the purposes of providing the Services.

  • Font Software means the software provided by Branding with Type which, when used on an appropriate Device or Devices, generates typeface and typographic designs and ornaments. Font Software shall include all bitmap representations of typeface and typographic designs and ornaments created by or derived from the Font Software. Font Software includes upgrades, updates, related files, permitted copies, permitted conversions, and related documentation.

  • Supported Software means the supported software identified in the Proposal. System means the designated information technology environment in which the Software is to be used. Term means the term of this Agreement specified in clause 2.

  • Hosted Software means the software owned and controlled by Vendor or Vendor’s third-party contractor that supports the Hosted Software Services.

  • Customer Software means software which is owned by or licensed to the Customer;

  • Proprietary Software means computer software developed for and owned by the Failed Bank for its own purpose and use.

  • Public Software means any Software that contains, or is derived in any manner (in whole or in part) from, any software that is distributed as free software, open source software (e.g., Linux) or similar licensing or distribution models, including, without limitation, software licensed or distributed under any of the following licenses or distribution models, or licenses or distribution models similar to any of the following: (A) GNU’s General Public License (GPL) or Lesser/Library GPL (LGPL), (B) the Artistic License (e.g., PERL), (C) the Mozilla Public License, (D) the Netscape Public License, (E) the Sun Community Source License (SCSL), (F) the Sun Industry Standards License (SISL), (G) the BSD License, and (H) the Apache License.

  • Embedded Software means one or more software applications which permanently reside on a computing device.

  • Malicious Software means any software program or code intended to destroy, interfere with, corrupt, or cause undesired effects on program files, data or other information, executable code or application software macros, whether or not its operation is immediate or delayed, and whether the malicious software is introduced wilfully, negligently or without knowledge of its existence.

  • Standard Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Standard Software.

  • Customized Software or “Customization” means any Application Software code modified or amended on behalf of the Customer. Setting of parameters, parameterization or configuration is not a Customization.

  • System Software means Software that provides the operating and management instructions for the underlying hardware and other components, and is identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Systems Software. Such System Software includes, but is not restricted to, micro-code embedded in hardware (i.e., “firmware”), operating systems, communications, system and network management, and utility software.

  • Business Software means with respect to a Licensor, all Software to the extent Controlled by such Licensor or any of its Affiliates as of the Effective Date, which Software is reasonably required as of the Effective Date for the conduct of (i) the Agriculture Business if the Licensee is AgCo, including as listed on section (i) of Schedule Q, or (ii) the Materials Science Business if the Licensee is MatCo, including as listed on section (ii) of Schedule Q, in each case (in respect of the foregoing (i) and (ii)), only if and to the extent such Licensee and its Affiliates have not been granted a license or other rights to use such Software under the Separation Agreement or any other Ancillary Agreement. Notwithstanding the foregoing, Business Software expressly excludes any and all Excluded IP.

  • Client Software means software that allows a Device to access or utilize the services or functionality provided by the Server Software.
