Upper Basin Demand Management Program definition

Upper Basin Demand Management Program refers to a program approved by the Upper Colorado River Commission consistent with this Demand Management Storage Agreement to reduce Consumptive Uses or augment water supplies with Imported Water, if needed, to help assure compliance with Article III of the Colorado River Compact without impairing the right to exercise any existing Upper Basin water rights in the future.

  • For purposes of this Companion Agreement, the Upper Basin DCP includes the Agreement for Drought Response Operations at the Initial Units of the Colorado River Storage Project Act and the Agreement Regarding Storage at Colorado River Storage Project Act Reservoirs Under an Upper Basin Demand Management Program (“Demand Management Storage Agreement”) which are attached and incorporated herein as Attachments A1 and A2.

  • The Secretary shall make such storage capacity available provided that the Commission requests use of the storage capacity for the purpose of storing water conserved as part of an Upper Basin Demand Management Program.

  • The Upper Division States, through the Commission, and the Secretary must enter into agreement(s) on the methodology, process and documentation for Verification and accounting for the creation, conveyance, and storage of conserved water to be stored in and released from a CRSPA Initial Unit as part of an Upper Basin Demand Management Program.

  • At the same time, new agreements that would protect water supplies in the short-term, such as the 500+ Plan, an Upper Basin Demand Management Program, and DROA Drought Plans, could themselves result in additional congressional involvement in funding, oversight, and/or enactment of new authorities.

  • The Upper Division States, through the Commission, shall have access to the Unfilled Storage Capacity authorized in Section II, supra, only upon development and approval of an Upper Basin Demand Management Program.

  • Develop the state’s position and approach on whether and how to develop any Upper Basin Demand Management Program that could potentially be implemented within Colorado consistent with state law to avoid or mitigate the risk of involuntary compact curtailment and to enhance certainty and security in the Colorado River water supply.

  • Any water conserved and stored under an Upper Basin Demand Management Program will be subject to evaporation assessments and volumetric limitations.

  • The Upper Division States and the Commission also acknowledge and expect that, at a minimum, any Upper Basin Demand Management Program implemented after 2025 would include the terms for feasibility and program development set forth in Section III.B.1 and III.B.2.a of this Demand Management Storage Agreement as well as the findings and approval provisions set forth herein.

  • Non-Administrator Dialysis Facility means a Dialysis Facility which does not have an agreement with the Claim Administrator or another Blue Cross and/or Blue Shield Plan but has been certified in accordance with the guidelines established by Medicare.

  • Storm water management plan means a comprehensive plan designed to reduce the discharge of pollutants from storm water after the site has under gone final stabilization following completion of the construction activity.

  • Participating Durable Medical Equipment Provider means a Durable Medical Equipment Provider who has a written agreement with the Claim Administrator or another Blue Cross and/or Blue Shield Plan to provide services to you at the time services are rendered.
