Upon Xxxxxx s receipt of a total of $300,000.00 on account of the amounts due under the LCS Note (inclusive of a $50,000.00 payment made by Guarantor prior to the date hereof), regardless of the source of funds, this Guaranty shall be deemed satisfied in full and released and no longer in force and effect.

Landlord warrants that the Premises currently comply with all laws, including the Americans with Disabilities Act ("ADA"). Tenant shall, at its own expense, comply, in its use of the Premises, with all future governmental regulations to include those relating to the ADA.

Upon Xxxxxx s execution of this Lease, Tenant shall deposit with Landlord the sum specified in Section 1.14, for the Security Deposit, which shall be held by Landlord as security for the faithful performance by Tenant of all of the terms, covenants, and conditions of this Lease, it being expressly understood and agreed that the Security Deposit is not an advance deposit for rent or a measure of Landlord's damages in case of Xxxxxx's default. The Security Deposit may be retained, used or applied by Landlord to remedy and default by Tenant, to repair damage caused by Tenant to any part of the Premises or the Building, and to clean the Premises upon expiration or earlier termination of this Lease, as well as to reimburse Landlord for any amount which Landlord may spend by reason of Tenant's default or to compensate Landlord for any other loss or damage which Landlord may suffer by reason of Tenant's default. If any portion of the Security Deposit is so used or applied, Tenant shall, within ten (10) days after written demand therefore, deposit cash with Landlord in an amount sufficient to restore the security Deposit to the full amount required hereunder, and Xxxxxx's failure to do so shall be a material breach of this
