University Patent Rights definition

University Patent Rights means rights in any patent application or patent covering any University Invention made by the University and/or the Principal Investigator during the course of the Research Program and arising directly from the performance of said Research Program, including any continuations, continuations-in-part, divisional applications, reexaminations, reissued patents, substitutions, extensions, or additions thereto, and any corresponding foreign patent applications or patents based on such applications or patents ("University Patent Application" or "University Patent", respectively).
University Patent Rights means Patent Rights claiming Inventions that arc conceived and reduced to practice solely by employees of University, as determined under the patent laws of the United States, and assigned to University. “Joint Patent Rights” means Patent Rights claiming Inventions that are conceived or reduced to practice jointly by employees of University and employees or consultants of Sponsor, as determined under the patent laws of the United States, and assigned to University or Sponsor.
University Patent Rights means U.S. Patent Application Numbers 10/479,638 and 10/488,056 and U.S. Patent(s) issuing thereon, and Patent Numbers 5,728810, 5,733,771, 5,756,677, 5,989,894, 5,994,099 and patent application(s) corresponding to all of the foregoing, owned by University, including any reissues, extensions (including governmental equivalents thereto), substitutions, continuations, (but limited to continuations-in-part which do no contain new subject matter not entitled to the priority date of the parent application) and divisions thereof.

  • If Company activates an Option during the relevant Option Activation Period, it shall reimburse University for all documented, out-of-pocket costs relating to the preparation, filing, prosecution and maintenance of the relevant University Patent Rights and Joint Patent Rights incurred by University prior to activation of the Option, as well as those incurred during the Option Exercise Period and Negotiation Period.

  • University shall be responsible, at its sole expense and discretion, for the preparation, filing, prosecution and maintenance of University Patent Rights.

  • This Agreement does not convey and shall not be construed to convey to LICENSEE, or any sublicensees, any right, title to or ownership in Licensed Inventions or Products, Processes or Services derived therefrom, National Textile University Patent Rights, other than that specified in this Agreement.

University Patent Rights means Patent Rights, including but not limited to: U.S. patent applications No. 60/042,941, filed April 4, 1997; U.S. patent application No. 60/042,666, filed April 4, 1997; U.S. patent application No. 09/055,145, filed April 3, 1998; U.S. patent application No. 09/797,238, filed Feb. 28, 2001; U.S. patent application No. 10/330,662, filed December 27, 2002; and all continuations, continuations-in-part, divisional, and reissue applications and patents issuing therefrom and extensions of such patents and all foreign counterpart patent applications thereto and continuation or divisional thereof and any patent issuing therefrom; any reissue or extension of any such foreign patent; any confirmation patent, registration patent or patent of addition based thereon and any related inventor’s certificate.
University Patent Rights means all Patent Rights owned or co-owned by University, but on which no Ceres’ inventors are named.
University Patent Rights the Curved Field Reflectron Patent Rights, the Inventions, or the Licensed Technology all to the extent and only to the extent conceived, developed or reduced to practice by employees or others acting on behalf of the Mass Spectrometry Lab of the School of Medicine of UNIVERSITY, either alone or jointly with others, arising out of research conducted pursuant to the Sponsored Research Agreement.

University Patent Rights means the United States and foreign patents set forth in Exhibit A, the United States and Foreign pending patent applications set forth in Exhibit A, the United States and Foreign Patents issuing from said pending United States and Foreign patent applications or later-filed United States or Foreign applications based upon any of said United States or Foreign patents or applications, any other patents or patent applications which are now or hereafter licensed to Bioanalysis pursuant to the UWCM Agreement, and any improvements, continuations, continuations-in-part, divisions, reissues or extension of any of the foregoing. C. "UWCM TECHNOLOGY" shall mean the technology covered by the University Patent Rights, which consists of certain compounds, materials, processes, and procedures relating to the use of stable derivatives of aryl acridinium esters as labeling agents in chemiluminescent assays such that (i)assay reagents may be labeled with such derivatives to very high densities, and (ii) such labeled assay reagents, following the triggering of a light emitting reaction, may be quantified or detected with high sensitivity by measuring or sensing the emitted light through simple photon counters.
University Patent Rights means (a) United States Patent No. -------------------------- 5,503,980, entitled "Positional Sequencing by Hybridization;" United States Patent Application No. 07/972,012, entitled "Positional Sequencing by Hybridization;" United States Patent Application No. 08/110,691 entitled "Positional Sequencing by Hybridization;" United States Patent Application No. 08/420,009, entitled "Solid Phase Sequencing of Biopolymers By Mass Spectrometry;" United States Patent Application No. 08/419,914, entitled "Solid Phase Sequencing of Nucleic Acids;" United States Patent Application No. 08/614/151 entitled "Solid Phase Sequencing of Double-Stranded Nucleic Acids;" and all patent applications, heretofore or hereafter filed or having legal force in any country within the Territory, embodying or produced through inventions conceived, discovered or reduced to practice, whether alone or with others, by UNIVERSITY employees or with UNIVERSITY facilities or equipment, in the course of any Research Program under the Sponsored Research Agreement, or otherwise regarding analysis, sequencing and detection of nucleic acids using mass spectrometry, which claim an invention in which UNIVERSITY has an ownership or other interest during the term of this Agreement, (b) all patents that have issued or in the future issue from the patent applications described in clause (a) above, including utility, model and design patents and certificates of invention, and (c) all divisions, continuations, continuations-in-part which are directed to subject matter specifically described in the U.S. Patents and Patent Applications listed above, reissues, renewals, extensions or additions to any such patent applications and patents, and any UNIVERSITY Improvements thereto upon which a patent application has been filed or a patent has issued. A list of the UNIVERSITY Patent Rights as of the date of the Agreement is attached hereto as Exhibit A.
University Patent Rights means all Patent Rights licensed from the University of Nijmegen to DiagnoCure directly related to the DiagnoCure Technology.
