Unit Firm definition

Unit Firm means, with respect to a Transaction, that the Product subject to the Transaction is intended to be supplied from a specified generation asset or assets specified in the Transaction. The following Products shall be considered “Unit Firm” products:

In any of such events, Seller shall not be liable to Buyer for any damages, including any amounts determined pursuant to Article Four.

Examples of Unit Firm in a sentence

  • The Product is Unit Firm energy having Environmental Attributes, including scheduling rights as provided hereunder, scheduled in accordance with then current CAISO tariffs in a scheduling coordinator to scheduling coordinator transaction.

  • The only Transaction contemplated in this Agreement is the sale and delivery to Buyer from Seller of the Unit Firm Product, including all Energy and capacity, as applicable, and Environmental Attributes associated with such Unit Firm Product, from the Project during the Delivery Term.


More Definitions of Unit Firm

Unit Firm means, with respect to a Product, that the Product is intended to be supplied from the Project, and subject to the terms of this Agreement, Seller is excused from selling and delivering the Product to Buyer, and Seller shall not be liable to Buyer for any damages determined pursuant to Section 3.1(h) of the Agreement, in the event that Seller fails to deliver the Product to Buyer for any of the following reason:

Unit Firm is amended (A) by replacing subclause “(i)” thereof with the following: “(i) if any portion of the specified generation assets are unavailable as a result of a “Forced Outage” (as defined below), or”, (B) by adding the following as the penultimate sentence: “In the event of a Forced Outage or receipt by Party A of a notice of a Forced Outage with respect to a Unit (as specified in the Confirmation under “Generating Units” (any of the same being hereafter called a “Generating Unit”)), Party A may reduce the Contract Energy required to be delivered during the period of such Forced Outage by a percentage whose numerator is the Forced Outage amount (expressed in MWs) for such Unit (as
Unit Firm shall have the meaning set forth in Schedule P, which is attached hereto. Baseload, Dispatchable and Peaking Products shall be considered Unit Firm products.
