Unamortized Investment definition

Unamortized Investment means the undepreciated value of Concessionaire’s investment in Build-Out Costs less the cost of Removable Trade Fixtures. The Build-Out Cost shall be fully amortized on a straight line basis over the term of this Agreement.
Unamortized Investment means as of any date the excess of (i) ---------------------- $500,000,000 over (ii) the sum of (X) an amount equal to (a) $500,000,000 multiplied by (b) the sum of the cumulative Monthly Equity Return Components shown on Schedule 7 as of such date plus (Y) the sum of the accreted values of all previous distributions to the Limited Partner pursuant to Sections 4.3(b), (c) and (d) (calculated by compounding quarterly each distribution at the pre-tax equivalent of the Minimum Rate from the date of distribution to the date of calculation).
Unamortized Investment means an amount equal to (i) the lesser of $208,000,000 and the amount actually expended by FSMC and/or Empire State Development Corporation prior to the termination, multiplied by (ii) a percentage, the numerator of which is equal to the difference between (x) $1,520,000,000 and (y) the amount of capital, operational and other costs incurred or spent by Tenant under Section 13.7 through the effective date of termination, and the denominator of which is equal to $1,520,000,000.”
