If the Trustee is removed upon three months’ written notice pursuant to paragraph (4) of the section entitled “Removal of Trustee” above, all costs and expenses (including the Trustee’s legal costs) properly incurred by the Trustee in respect of such removal shall be Trustee Expenses.
Section 185 of the Charities Act 2011 includes a power to pay trustees for goods or services delivered to the charity, provided that: a) such payment is not expressly prohibited by the governing document; b) only a minority of trustees are so paid; and c) other conditions are met (Charity Commission Publication, "Trustee Expenses and Payments," CC11, March 2012).
