Third Party Product Terms of Use means contractual terms specific to the use of Third Party Product made available by OVHcloud within the framework of the Services.

  • In the event of contradiction, the Specific Terms of Service, as well as the General Terms of Service, shall prevail over the Third Party Product Terms of Use.

  • Notwithstanding the foregoing, any change to Third Party Product Terms of Use and any implementation of a new regulation may be immediately applicable to the extent OVHcloud does not control such events.

  • In particular, the Client undertakes to comply with these General Terms of Service, the Specific Terms of Service and the applicable Third Party Product Terms of Use, as well as any information communicated to the Client at the time of the Order.

  • The use and/or the download of Third Party provided by OVHcloud in the provision of the Services constitutes acceptance of the Third Party Product Terms of Use in accordance with Article 3.11.

  • The provision and use of the Services are governed by these Terms of Service, the Specific Terms of Services applicable to the selected Services, any other conditions referred by the General Terms of Services and Specific Terms of Service, such as Third Party Product Terms of Use, along with any other information given to the Client during the Order (“Terms of Service”).

  • The use of Third Party Products (such as software programs, systems, applications, etc.) provided by OVH in the provision of the Services may be subject to specific terms of use (referred to as Third Party Product Terms of Use).

  • In particular, the Client undertakes to comply with these General Terms and Conditions of Service, the Special Terms of Service, and the applicable Third Party Product Terms of Use, as well as any information communicated to the Client at the time of the Order.

  • The provision and use of the Services are governed by these Terms and Conditions of Service, the Special Terms of Services applicable to the concerned Services, any other conditions referred by the General Terms and Conditions of Service and Special Terms of Service, such as Third Party Product Terms of Use and OVH Deontological Charter, along with any other information given to the Client during the Order (“Terms of Service”).

Related to Third Party Product Terms of Use

  • Third Party Products means the Third Party Software and Third Party Hardware.

  • Third Party Product means a product (whether hardware, software or services) supplied to you by a third party;

  • Product Terms means the document that provides information about Microsoft Products and Professional Services available through volume licensing. The Product Terms document is published on the Licensing Site and is updated from time to time.

  • New Products means any product which is not an Enhanced Product or 2 Existing Product but which is substantially similar to an Existing Product with respect to design and function and possesses reasonable performance improvements. If Company desires to purchase an Enhanced or New Product(s) from Supplier, Company shall so notify Supplier and provide Supplier the opportunity to manufacture such Enhanced or New Product(s), subject to the following conditions and procedures.

  • Third Party Terms means, if any, the end user license agreement(s) or similar terms for the Third Party Software, as applicable and attached as Exhibit D.

  • End User License means any license terms imposed by any Third Party Vendor on Customers and End Users. “Force Majeure Event” means an event or occurrence:

  • New Product means the Synology-branded hardware product and Synology-branded accessories contained in the original packaging Customer bought from an authorized Synology distributor or reseller. You may see our “New Product” at Product Support Status.

  • Licensed Fields of Use means the fields of use identified in Appendix B.

  • Third Party Technology means all Intellectual Property and products owned by third parties and licensed pursuant to Third Party Licenses.

  • Licensed Products means tangible materials which, in the course of manufacture, use, sale, or importation, would be within the scope of one or more claims of the Licensed Patent Rights that have not been held unpatentable, invalid or unenforceable by an unappealed or unappealable judgment of a court of competent jurisdiction.

  • Licensed Product means any method, process, composition, product, service, or component part thereof that would, but for the granting of the rights set forth in this Agreement, infringe a Valid Claim contained in the Licensed Patents.

  • Terms of Use means any privacy policy, terms of use or other terms and conditions made applicable by BNYM in connection with the Company’s or a Permitted User’s access to and use of a Component System or a BNYM Web Application or other access site or access method.

  • Third Party License means licenses from third parties governing third party software embedded or used in the Trading Platform.

  • End User License Agreement means a license grant or end user license agreement governing software as further described in this Agreement or any applicable Appendix.

  • Third Party Materials means any materials and information, including documents, data, know-how, ideas, methodologies, specifications, software, content, and technology, in any form or media, in which any Person other than the State or Contractor owns any Intellectual Property Right, but excluding Open-Source Components.

  • Third Party Components means software and interfaces, licensed by RIM from a third party for incorporation into a RIM software product, or for incorporation into firmware in the case of RIM hardware products, and distributed as an integral part of that RIM product under a RIM brand, but shall not include Third Party Software.

  • Licensed Field of Use means all fields.

  • Third Party Licensor means the relevant licensor of any Third Party Data or any Third Party Trade Xxxx;

  • Third Party Hardware means the third party hardware, if any, identified in the Investment Summary.

  • Third Party Content means all software, data, text, images, audio, video, photographs and other content and material, in any format, that are obtained or derived from third party sources outside of Oracle that You may access through, within, or in conjunction with Your use of, the Services. Examples of Third Party Content include data feeds from social network services, rss feeds from blog posts, Oracle data marketplaces and libraries, dictionaries, and marketing data. Third Party Content includes third-party sourced materials accessed or obtained by Your use of the Services or any Oracle-provided tools.

  • Third Party Data has the meaning set forth in Section 9.3(a).

  • Covered Products means Your Applications, Libraries, Passes, Safari Extensions, Safari Push Notifications, and/or FPS implementations developed under this Agreement.

  • Licensed Field means all fields of use.

  • Collaboration Product means a pharmaceutical product containing or comprising Compound in any dosage form alone, or in combination with, one or more other pharmaceutically active ingredients, and any and all Improvements thereto.

  • Third Party Material means software, software development tools, methodologies, ideas, methods, processes, concepts and techniques owned by, or licensed to a third party and used by the Service Provider in the performance of the Services;

  • Product means any deliverable under the Contract, which may include commodities, services, technology or software.
